âyette muhalefetten dolayı سوء المعاشرة / sû-i muâşeret/kötü muamele veya المعاشرة بالإكراه /el-muâşere bi’l-ikrâh olarak isimlendirilmesi gerektiğini söylemektedirler.Genel olarak çağdaş müellifler, evlilikte kocanın, güç kullanarak rızası dışında karısı ile zorla cinsel birliktelik yaşamasının nitelikli cinsel saldırı olarak değerlendirmemektedirler. Bununla birlikte çağdaş müellifler, evlilikte karı-koca arasındaki cinsel faydalanmanın zorla değil, karşılıklı rıza ve uyum içerisinde olması gerektiğini; fiziki şiddet ve zarar içermesi halinde kadının mahkemede şikâyetçi olma hakkının olduğunu ve isnat edilen suçun sabit olması halinde kocanın ta’zîr ile cezalandırılmasının mümkün olduğunu söylemektedirler.
Bu makalede fıkhî açıdan evlilik içi kadın eş ile (normal yoldan) zorla cinsel birlikteliğin “nitelikli cinsel saldırı suçu” kapsamında değerlendirilip değerlendirlmemesi üzerinde durulacaktır.

Evaluation Of Forced Sexual Intercourse With a Female Spouse Within Marriage As a Crime Of Aggravated Sexual Assault From a Jurisprudential Perspective
Öz
In general, sexual acts prohibited by penal laws in a society are called sexual crimes. The crime of sexual assault is the violation of the bodily integrity of another person (the victim) without their consent in order to satisfy sexual desires. In this context, one of the issues that creates tension/conflict between Turkish law and Islamic law in the context of dual legitimacy today is whether the husband's sexual intercourse with his wife by using force without her consent can be considered within the scope of the crime of aggravated sexual assault. The Turkish Penal Code No. 5237 dated 2004 (TCK, article 102/2) also considered the forced sexual intercourse of a husband with his wife without her consent within the scope of the crime of aggravated sexual assault. According to the regulation in the TCK, although it is possible for the perpetrator of the crime of aggravated sexual assault to be both husband and wife, when we look at the doctrine and court records, it can be said that this crime is generally valid for the husband/wife. In principle, although sexuality is a right for both husband and wife in a marital union, Islamic jurists, especially those who take into account the narrations transmitted from the Prophet, have placed a separate responsibility on women in this regard; they have stated that it is a religious obligation imposed on women by marriage to respond to their husband’s request for sexual intercourse unless they have a legitimate excuse such as illness, menstruation, postpartum, or the state of ihram, etc. Therefore, from the perspective of classical jurisprudential doctrine, a husband’s forced sexual intercourse with his wife without her consent is not considered a crime of qualified sexual assault unless he has a legitimate excuse. The issue of whether a husband’s forced sexual intercourse with his wife without her consent within marriage constitutes a crime of sexual assault has entered the agenda of contemporary Islamic jurists after recent legal regulations in Western law have been made regarding the crime of qualified sexual assault between spouses within marriage. This situation is generally expressed in contemporary literature with the term الاغتصاب الزوجي / el-İğtisâbü’z-zevcî/sexual assault of a husband against his wife. However, some contemporary writers argue that a husband’s forced sexual intercourse with his wife without her consent is not considered iğtisâb/rape but rather an-Nisa 4/19, which commands good relations with women. They say that due to the opposition in the verse, it should be called su-i muâşeret/ill treatment or al-muâşere bi’l-ikrâh. In general, contemporary authors do not consider it as qualified sexual assault when a husband uses force to have sexual intercourse with his wife against her will. However, contemporary authors state that sexual intercourse between a husband and wife in a marriage should not be by force, but by mutual consent and harmony; that if it involves physical violence and harm, the woman has the right to complain in court, and that if the alleged crime is proven, the husband can be punished with ta’zir.
This article will focus on the evaluation of forced sexual intercourse with a female spouse within the scope of the crime of qualified sexual assault from a fiqh perspective.
