Evaluation of Covertainer Transportation System within Existing Regulations and Systems

Öz

In this context, the legal system governing international maritime transport and the actions it is obligated to implement have been examined, and the legal framework has been determined using case examples. However, this study also aims to introduce a proposed solution called the covertainer transport system. The covertainer transportation system refers to a transportation system that aims to transport bulk cargo in large (250m3), elastic bags, thereby eliminating the need for tank and hold cleaning. The system thus presents an alternative solution to the problem of ships leaving port without cargo. This study examines the feasibility of using the covertainer transportation system for the maritime transport of liquid or dry bulk cargo, its advantages and disadvantages in terms of compliance with existing international maritime law, and compares it with other transportation systems. Within this framework, the aim is to contribute to the literature on the covertainer transportation system. The study is considered important as a guide for the development of alternative transportation systems for the transport of cargo by sea.

Covertainer Taşımacılık Sisteminin Mevcut Mevzuat Çerçevesinde Diğer Sistemler İçerisinde Değerlendirilmesi

Öz

Günümüzde denizyolu taşımacılık sisteminde dökme sıvı ve kuru yük taşıyan gemiler tahliyeden sonra tank ve ambarlarını yeni yük taşımasına hazırlayabilmek için ambarlarının yıkanması zorunluluğu ile karşılaşmakta, bu sebeple de gemiler limandan boş olarak hareket etmek zorunda kalmaktadırlar. Bu nedenle işbu çalışmada, uluslararası deniz taşımacılığının tabi olduğu hukuk sistemi ve uygulamakla yükümlü olduğu eylemler incelenmiş ve dava örnekleri ile hukuki çerçeve çizilmiştir. Ancak bu çalışmada covertainer taşımacılık sistemi olarak isimlendirilen bir çözüm önerisinin tanıtılması da amaçlanmıştır. Covertainer taşımacılık sistemi; büyük ebatlı (250m3), elastik yapıda torbalar ile dökme olarak yüklerin taşınması ve bu sayede tank ve ambar yıkamalarının ortadan kaldırılmasını hedefleyen bir taşıma sistemini ifade etmektedir. Sistem bu sayede geminin limandan yüksüz bir şekilde kalkma sorununa da alternatif bir çözüm olarak ortaya çıkmaktadır. Bu çalışmada covertainer taşımacılık sisteminin, sıvı veya kuru dökme yüklerin deniz yolu ile taşınmasında kullanılabilirliği ve avantaj ve dezavantajlarının mevcut uluslararası deniz ticaret hukuku mevzuatına uyumu incelenmiş ve diğer taşıma sistemleri ile karşılaştırılması yapılmıştır. Bu çerçevede covertainer taşımacılık sistemi’nin literatüre kazandırılması amaçlanmıştır. Çalışma yüklerin deniz yolu ile taşınmasında da alternatif taşımacılık sistemlerinin geliştirilmesinde bir rehber olması yönüyle önemli görülmektedir.
