Deniz Alanlarının Sınırlandırılması Süreci

Öz

Uluslararası sınırlandırma hukukunun yegâne amacı hakkaniyete uygun bir çözüme ulaşılmasıdır. İlgili uluslararası sözleşmeler, uluslararası teamül hukuku ve uluslararası içtihatlar ile Devlet uygulamaları ışığında, bu makale Deniz Yetki Alanı Sınırlandırmasında hakkaniyete uygun bir sonuç elde edilmesi gerektiği hususunu irdelemeyi hedeflemektedir. Halihazırda, deniz sınırlandırmasının hakkaniyete uygun ilkeler çerçevesin de yapılması gerektiğine ilişkin hiçbir tereddüt bulunmamaktadır.

Maritime Boundary Delimitation Process

Öz

Achieving an equitable result is the single consideration prescribed by international maritime delimitation law. This article aims to analyze the requirement of achieving an equitable result in the Maritime Boundary Delimitation process in the light of relevant international conventions, customary international law, international jurisprudence and State practice. At present, there is no doubt that maritime delimitation should be governed by equitable principles.
