BİYOÇEŞİTLİLİĞİN İNSAN HAKLARI PERSPEKTİFİNDEN KORUNMASINA İLİŞKİN BİR DEĞERLENDİRME
Öz
Genler, türler ve ekosistemler arasındaki çeşitliliği, genel anlamıyla Dünyadaki yaşam çeşitliliğini ifade eden biyoçeşitlilik, doğaya ve insanlığa sağladığı faydalar göz önüne alındığında, korunmasında hayatî menfaatler bulunan bir değerler bütünü oluşturmaktadır. Teşkil ettiği değerler bütünü bakımından biyoçeşitliliğin korunmasında da farklı anlayışlar öne sürülmektedir. Bu bağlamda çevrenin korunması genel boyutuyla, ekoloji merkezli ve içsel değeri esas alan yaklaşımlar olduğu gibi, daha insan merkezli açıyla, araçsal değeri ve biyoçeşitliliğin ekosistem hizmetleriyle birlikte insanlığa sağladığı faydaları ön plana alan yaklaşımlar da bulunmaktadır. Son zamanlarda biyoçeşitliliğin korunmasında, konuya insan hakları perspektifiyle yaklaşılması da tercih edilir olmuştur. Bu çerçevede, yaşanan gelişmeler ile birlikte birçok insan hakkının gerçekleşmesi ve bunlardan yararlanma bakımından gerekli ve/veya ön koşul olan biyoçeşitliliğin insan hakları boyutuyla korunması, değerlendirilmesi gereken konuların başında gelmektedir. Bu çalışmada da biyoçeşitliliğin korunması, insan hakları perspektifiyle ele alınacaktır. Biyoçeşitliliğin korunmasının düşünsel boyutu çerçevesinde, varlıksal ve araçsal değer göz önüne alınarak, ekoloji merkezli ve insan merkezli yaklaşımlar etrafında, konuya insan hakları penceresinden bakmanın anlamı, konumu ve önemi tartışılacaktır. Biyoçeşitliliğin korunmasının insanlık için önemi değerlendirilecek, insan hakları yaklaşımının, korumanın geleceğini hangi yönlerden nasıl şekillendirebileceği irdelenecektir. Hem geleneksel insan hakları ekseninde hem de bağlantılı ancak ayrı olarak, temiz, sağlıklı ve sürdürülebilir çevre hakkı ekseninde değerlendirmeler yapılacaktır. Nihayetinde çalışmada, özellikle, biyoçeşitliliğin kaybının temel insan hakları ile doğrudan ilişkisi olduğunun, biyoçeşitliliğin korunmasında çevre ve insan merkezli bakış açıları ile içsel ve araçsal değer anlayışların bağdaştırılabilir olduğunun ve koruma çerçevesinin geliştirilmesi için tek ve mutlak yolun ayrı bir hak olarak tanınma olmadığının, böyle bir gereklilik bulunmadığının altı çizilecektir. Bu bakımdan biyoçeşitliliğin, birçok temel insan hakkının gerçekleşmesi için hâlihazırda zaruri unsurlardan biri olduğu, bu haklar bakımından korunmasına odaklanılmasında, bu yönde bilinç ve farkındalığın arttırılmasında gösterilecek çabaların, aynı zamanda beraberinde koruma çerçevesini de geliştireceği; dolayısıyla ayrı bir hak olarak tanımayı beklemenin yerinde ve/veya gerekli olmayacağı vurgulanacaktır.

AN ASSESSMENT OF THE PROTECTION OF BIODIVERSITY FROM A HUMAN RIGHTS PERSPECTIVE
Öz
Biodiversity, which refers to the diversity among genes, species, and ecosystems, and in a broader sense, to the diversity of life on Earth, constitutes a set of values whose protection is of vital importance, considering the benefits it provides to nature and humanity. Different approaches to the protection of biodiversity are put forward based on the set of values it represents. In this context, environmental protection encompasses both ecology-centered approaches that emphasize intrinsic value and more human-centered approaches that prioritize instrumental value and the benefits biodiversity provides to humanity through ecosystem services. Recently, it has also become preferable to approach biodiversity protection from a human rights perspective. In this context, protecting and evaluating biodiversity in terms of human rights is one of the most important issues, as it is necessary and/or a prerequisite for the realization of many human rights and the enjoyment thereof. This study will address the protection of biodiversity from a human rights perspective. Within the conceptual framework of biodiversity protection, the meaning, position, and importance of viewing the issue through the lens of human rights will be discussed, taking into account its intrinsic and instrumental value, and focusing on ecology-centered and human-centered approaches. The importance of biodiversity protection for humanity will be assessed, and the ways in which the human rights approach can shape the future of protection will be examined. Assessments will be made both within the traditional human rights framework and, separately but related, within the framework of the right to a clean, healthy, and sustainable environment. Ultimately, the study will emphasize, in particular, that the loss of biodiversity is directly linked to fundamental human rights; that environmental and human-centered perspectives, along with conceptions of intrinsic and instrumental value, can be reconciled in the protection of biodiversity; and that recognizing biodiversity as a separate right is not the sole or absolute path for developing a protection framework, nor is there any such necessity. In this regard, it will be emphasized that biodiversity is already an essential element for the realization of many fundamental human rights, that efforts to focus on its protection in relation to these rights and to raise awareness and understanding in this regard will also contribute to the development of the protection framework; and therefore, it would not be appropriate and/or necessary to expect it to be recognized as a separate right.
