Şeyh Bedreddin Molla Hüsrev et-Teshîl Dürerü’l-hükkâm Fâzıl Emîr Dürer Hâşiyeleri
Criticism and critical approach, which have a very important place in our fiqh tradition, have been existed among different fiqh madhhabs or jurists of the same madhhab. It is known that this culture was kept alive especially in Abu Hanifa’s fiqh lessons. One of those who adopted this critical method by questioning consistency within the sect is Sheikh Bedreddin, one of the important jurists of the Hanafi Fiqh School in the Ottoman geography. His criticisms did not go unanswered within the madhhab; the great scholar Molla Husrev, who was educated by the Ottoman Empire, responded to Bedreddin’s objections with a harsh style in his work on fiqh, Durar. In this article, the aforementioned criticisms of these two scholars, who left permanent marks in the Hanafi Law Literature, were included. Biographies of both jurists and their works on fiqh were briefly touched upon as an introduction to the subject; evaluations were made on these points by making use of the opinions of other scholars who were involved in the discussions.
