PERİNÇEK v. SWITZERLAND JUDGEMENT OF THE EUROPEAN COURT OF HUMAN RIGHTS

Öz

The verdict of the ECtHR in Perinçek v. Switzerland affair is awell-reasoned and balanced judgment; it reduces the concept of genocideto law. The ECtHR acknowledges that the Court is not competent toarbitrate upon controversial historical aspects of the past events as well ason the legal qualification attributed to them. The line of reasoning of theSwiss Courts on the matter was troubling as it came very close toestablishing a system which places one single opinion above all others,which criminalizes disagreement and precludes any form of debate. Theverdict of the ECtHR underlined that expressing opinions on sensitive anddebated issues is a fundamental aspect of freedom of expression and thedifference between tolerant, pluralist, and democratic society andtotalitarian regimes lies in this. The Court concluded that there was nojustifiable reason to curtail Dr. Perinçek’s freedom of expression

AVRUPA İNSAN HAKLARI MAHKEMESİ’NİN PERİNÇEK-İSVİÇRE KARARI

Öz

AİHM’nin Perinçek-İsviçre davasındaki kararı iyi gerekçelendirilmiş,dengeli bir karardır. Bu karar soykırımı kavramını hukuksal boyutaindirgemektedir. AİHM, tarihsel olayların tartışmalı boyutları konusundaolduğu gibi, bunlara yüklenen hukuksal nitelemeler hakkında hakemlik etmeyetkisinin bulunmadığını kabul etmektedir. İsviçre Mahkemelerinin bu davahakkındaki mantıksal dayanağı rahatsızlık yaratır nitelikteydi; zira tek birgörüşü öbür düşüncelerin önüne geçirmekte, farklı görüş sahibi olanıcezalandırmakta ve o konuda her türlü tartışmayı engellemekteydi.AİHM’ni kararı duyarlı ve tartışmalı konularda görüş serdetmenin ifadeözgürlüğünün temel niteliği olduğunun, hoşgörülü, çoğulcu ve demokratikbir toplum ile totaliter rejimler arasındaki farkı da bunun oluşturduğununaltını çizmiştir. AİHM Dr. Perinçek’in ifade özgürlüğünü kısıtlamakonusunda geçerli bir gerekçe bulunmadığı sonucuna varmıştır
