Öz

Yasanın genelliği muhakeme sürecindeki pek çok sorunun kaynağıdır. Yasadaki genel kavram, olayı tüm detaylarıyla açıklayamaz. Bu nedenle yasa doğası gereği daima eksiktir. Platon ve Aristoteles, yasanın bu eksikliğini gidermek için farklı öğretiler geliştirir. Platon zor davalar için önce devlet adamını yetkili kılar. Ne var ki da ha sonra hukukun üstünlüğünü kabul eder ve bu sorumluluğu yasa koyucu ve yasa bekçilerine devreder. Aristoteles ise beklenmedik olaylar için yargı mercii olan hakeme müracaat etmeyi tavsiye eder. Hakem, yargıcın aksine, taraflar arasında uzlaşma sağlamayı hedefler. Yasaları esnek biçimde yorumlar ve hakkaniyete en uygun kararı verir. Her iki düşünür de bu girişimleriyle yasanın genelliğinden kaynaklanan sorunların bilincinde olduğunu kanıtlar.

The Opinions of Plato and Aristotle on the Principle of “Generality of Law” as an Ancient Problem

Öz

The generality of the law is the source of many problems in the reasoning process. General statement in the law cannot cover the event in all its details. Therefore, the law is always incomplete by nature. Plato and Aristotle put forward different doctrines to remedy this deficiency of the law. Plato firstly empowers the states man for hard cases. Later, however, he recognizes the rule of law and delegates this responsibility to the legislator and the guardians of the law. Aristotle, on the other hand, recommends appealing to the arbitrator, which is a judicial authority, for unexpected events. The arbitrator, unlike the judge, aims to reach a compromise between the parties. He interprets the law flexibly and makes the most equitable decision. By these attempts, both thinkers demonstrate that they are aware of the problems arising from the generality of the law.
