Kira sözleşmesi, kiraya verenin kira konusu şeyin kullanılmasını veya kullanmayla birlikte ondan yararlanılmasını kiracıya bırakmayı, kiracının da buna karşılık kararlaştırılan kira bedelini ödemeyi üstlendiği sözleşme olarak tanımlanır. Kira sözleşmesinin bir çeşidi olan konut kirasının alt türü turizm amaçlı konut kirasıdır.
Turizm amaçlı konut kirası sözleşmesi, 7464 Sayılı Konutların Turizm Amaçlı Kiralanması ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun ile Konutların Turizm Amaçlı Kiralanması Faaliyetlerinin Düzenlenmesine İlişkin Yönetmelik’te düzenlenir. Kanun ve buna bağlı çıkarılan Yönetmelik’te konutların gerçek ve tüzel kişilere turizm amaçlı kiralanmasına ilişkin usul ve esaslar belirlenmektir. Turizm amaçlı konut kirası sözleşmesinde turizm amacıyla hareket etme ön plana çıkar. Yasal düzenlemelere de bakıldığında turizm amacının öncelikli olduğu ve yapılan tespitlerin bu amaç dikkate alınarak ortaya koyulduğu söylenebilir.

Rental agreement is defined as a contract in which the landlord undertakes to leave the use of the thing subject to rental or the benefit from it along with use to the tenant, and the tenant undertakes to pay the agreed rental amount in return. A special type of rental agreement, which is a type of rental agreement, can be referred to as a residential rental agreement for tourism purposes.
Residential rental agreements for tourism purposes are regulated in the Law No. 7464 on Renting of Residentials for Tourism Purposes and Amending Certain Laws and the Regulation on the Regulation of Activities of Renting Houses for Tourism Purposes. The Law and the Regulation issued accordingly determine the procedures and principles regarding the rental of residentials to real and legal persons for tourism purposes. Acting for tourism purposes comes to the fore in the residential rental agreement for tourism purposes. Considering the legal regulations, it can be said that tourism is the primary purpose and the findings are made taking this purpose into consideration.
In rentals for tourism purposes, the subject of the contract is residential. Residential using refers to any independent section that is registered in the land registry for residential purposes or has a residential floor easement or condominium on it. However, the subject of a residential rental agreement for tourism purposes can also be high quality residential. In addition, a residential rental agreement for tourism purposes can be made for tiny houses and buildings that have a building registration certificate.
The parties to the residential rental agreement for tourism purposes are the landlord and the tenant. In a residential rental agreement for tourism purposes, the landlord may be a real or legal person who owns the property or who possesses the property by establishing usufruct or superficies. In this agreement, the tenant is the renter. It is possible for the tenant to be a real or legal person.
In a residential rental agreement for tourism purposes, the tenant must pay a fee to the landlord. It is possible to benefit from comparable rents when determining the rental amount in this type of rental agreement. However, since the rental period cannot exceed one hundred days, the daily rental fee must be determined and the rental amount must be determined by calculating the number of days used.
The residential rental agreement for tourism purposes will be made for a period of one hundred days or less than one hundred days for a one time. There is a limitation in terms of the duration of the contract. Although the subject of the residential rental agreement for tourism purposes is the residentials, it is seen that there is a different application in terms of the rental period with the Law and Regulation.
Obligations arising within the scope of the contract are addressed in the Regulation from the perspective of the permit holder. To deliver accordingly, to carry out cleaning and maintenance works related to the residential after each user change, inform users about the rules taken by the site or building management, it is the obligation to fulfill the existing obligations in line with the Personal Data Protection Law and relevant regulations and to hang the plaque prepared by the Ministry at the entrance of the house.
A regulation regarding the termination of the contract is included in the ninth paragraph of Article 3 of the Law. Accordingly, the residential rental agreement for tourism purposes terminates automatically at the end of the rental period specified in the agreement. This regulation is especially applicable if the tenant evicts at the end of the term. However,
there is no regulation on what to do if the tenant does not vacate the residential, neither in the Law nor in the Regulation.
