THE JUSTIFICATION OF PUNISHMENT IN PLATO

Abstract

In this study we have investigated the arguments that try to justify and legitimize the punishment in Plato’s works. The main question of the study was formulated as “How does Plato legitimize punishment?”. In this framework, we have focused mostly on the analysis of the dialogues of Plato, such as Protagoras, Gorgias, the Republic and the Laws which contains some basic ideas providing a basis for punishment. The problem has been discussed in two parts; in the first, we have examined Plato’s justice representation and in the second the arguments that philosopher thinks demonstrates validity of punishment. In the last instance, in Plato's philosophy, justice has been described as a state of harmony and unity manifested by everyone both indivudually and socially, by fulfilling their duties appropriates to them and by not interfering in the affairs of the others. For this reason, it has been asserted that any wrong/bad action that harms this harmony and unity should be punished. Plato is certain that the crime/criminal should be punished; because, according to him, the person who got sick by committing a crime will only recover, that is to say will reach moral balance, by way of punsihment. However, Plato's concept of punitive justice ultimately consists of the arguments of redressal, deterrence, and especially redeeming, which are the more visible bases of punishment.

PLATON’DA CEZANIN TEMELLENDİRİLMESİ

Öz

Bu çalışmada Platon’da cezayı haklı ve meşru göstermeye çalışan argümanlar araştırılmıştır. Çalışmanın temel sorusu “Platon cezayı nasıl meşru kılmaktadır?” şeklinde formüle edilmiş ve bu çerçevede; filozofun, daha çok Protagoras, Gorgias, Devlet ve Yasalar adlı diyaloglarında yer alan ve cezaya dayanak sunan malzemenin analizine odaklanılmıştır. Problem iki bölümde ele alınmış olup, ilkinde Platon’un adalet tasarımına ikincide ise cezalandırmaya dayanak olarak gösterdiği argümanlara yer verilmiştir. Son tahlilde Platon felsefesinde adalet, gerek bireysel gerekse toplumsal ölçekte, herkesin kendi yeteneğine uygun düşen görevi yerine getirip, başkasının işine karışmaması ile tecelli eden bir uyum ve birlik hâli olarak tarif edilmiş, nasıl olursa olsun, bu uyum ve birlik hâline zarar veren her tür yanlış/kötü fiilin cezalandırılması gerektiği öne sürülmüştür. Platon suçun/suçlunun cezalandırılması gerektiğinden emindir; çünkü ona göre suç işleyerek, bir bakıma, hastalanmış olan birey ancak ceza görürse iyileşebilecek, yani kaybettiği moral dengeye ulaşabilecektir. Bununla birlikte Platon’un cezalandırıcı adalet konsepti, en nihayetinde cezanın daha görünür dayanakları olan tazmin etme, caydırma ve özellikle ıslah etme argümanıyla tamamlanmaktadır.
