State of Exception as the Nomos of the Modern Sovereignty

Abstract

The distinguishing part of the theory of modern state is the sovereignty itself. Sovereignty was established on eliminating the dichotomy and diminishing the space between Principle Auctoritas and Power Potestas which had demonstrated itself in Middle Age politics. The modern state, then, arises as a unit which legislates its principle from inside of itself. Although, in the presovereignty times, the legislation of Power had depended on the Principle which is outside of it, the Power started to determine its legislative category since the case of sovereignty was born. The state of exception signs that regular process of sovereignty in this context. The term of state of exception which is called as “suspending of law” connotes of diminishing the space between Principle and Power, even transforming of Power into the Principle itself as well. The aim of this article is to emphasize that the exception which is also reffered as “state of emergency” reflects a usual case and, so, it is the core element of the theory of the modern sovereignty

MODERN EGEMENLİĞİN ‘NOMOS’U OLARAK İSTİSNA HALİ

Öz

Modern devlet kuramının ayırt edici özelliği egemenliğin kendisidir. Egemenlik, Orta Çağ siyasallığında kendisini gösteren iktidarın ilkesi ile onun uygulanması Auctoritas-Potestas ikiliğinin ortadan kaldırılması ve bu ikisi arasındaki mesafenin daraltılması üzerine inşa edilmiştir. Modern devlet, böylece, ilkesini kendi içerisinden meşrulaştıran bir birim olarak ortaya çıkmıştır. Daha önceki dönemlerde Uygulamanın meşruluğu, kendisinin dışında var olan Yasa’ya bağlı iken, egemenlik ile başlayan süreçte Uygulama, kendi meşruiyet kategorisini kendisi belirler hale gelmiştir. İstisna hali, bu bağlamda egemenliğin olağan bir sürecine işaret eder. Terminolojik düzeyde “hukuku askıya alma” olarak adlandırılan istisna hali, tam da bu bağlamda Auctoritas İlke -Potestas Devlet arasındaki mesafenin daraltılması, hatta iktidarın uygulama biçiminin bizatihi Yasa halini alması fikri üzerine oturur. Bu makale, “olağanüstü hal” olarak bilinen istisna’nın, modern egemenlik kuramsallığı içerisinde aslında “olağan” bir durumu yansıttığını ve, böylece, istisna halinin modern egemenlik kuramının özü olduğunu öne sürecektir
