RUS DEVRİMLERİ ARASINDA ORENBURG MAHKEME-İ ŞERİYESİ (1905-1917)
Öz
Çalışmamız Rusya’daki Müslüman tebaanın dini ve kültürel haklarında mutlakıyet ile meşrutiyet devirlerinde anlamlı bir değişiklik olup olmadığı incelenmiştir. Bu durumun belirlenmesine Orenburg Mahkeme-i Şeriyesinin 1905-1917 yılları arasındaki faaliyetlerinin incelenmesi açıklayıcı bir örnek olarak görülmüş ve ele alınmıştır. Çarlığın talepleri Müslüman tebaanın hassasiyetleri göz önünde bulundurulmadan Müftülük üzerinden duyurulduğunda halk arasında ciddi rahatsızlık yarattığı ve Müftülerin kamuoyu baskısına duyarlı olduğu gösterilmiştir. Müftülüğün din görevlilerinin bağlı olduğu en yüksek makam olarak halk arasında bir meşruiyete sahip olduğu anlaşılmaktadır. Camilerin, mektep ve medreselerin bunlarda görev yapan imam, muallim ve müderrislerin Müftülük denetim ve sorumluluğunda olması bu kurumun manevi ağırlığını artıran hususlardır. Müslüman tebaanın kimlik, kültür ve inancını koruma ve devam ettirmede halkın daha fazla söz sahibi olma arzusu Meşrutiyet devrinde söz, basın ve toplantı hürriyet ile daha belirgin ve Çarlık yönetimini zorlayıcı bir hal almıştır. Bu durumu Müftülük kendi konumunu gerek halk gerek Çarlık hükümeti nezdinde kuvvetlendirme ve tavrı içerisinde olmuştur. 1905 Ulema kurultayı bu doğrultuda düzenlenmiştir. Ancak çarlık bürokrasisi genel meşrutiyet ilkelerine karşı baskıcı bir tutum benimsemiş bunun yansımaları Orenburg Mahkeme-i Şeriyesi hakkındaki toplantı ve düzenlemelerde görülmüştür. 1910 yılında yapılmak istenen yeni bir kurultay halkın geniş destek ve talebine rağmen gerçekleşmemiştir. 1913 yılında Ufa’da düzenlenen danışma toplantısı konu ve çerçevesini Çarlık yöneticilerinin belirlediği bir çalışma idi. 1914 baharında Rusya Müslümanalrı hakkındaki toplantıda ise çoğunluk tamamen Çarlık yöneticilerinden oluşmaktaydı. Burada özellikle Müftülerin atanma usulüyle seçilme usulünün kabul edilmesi meşrutiyet anlayışı ve değerlerine aykırı olmuştur. Bu toplantıdan kısa süre sonra Orenburg Mahkme-i Şeriyesine atama yoluyla ve Müslüman tebaa tarafında güvenilir bulunmayan bir Müftünün getirilmesi Müftülük ile halk arasındaki münasebetleri kopma noktasına getirmiştir. Müftünün görevden alınması teşebbüsleri sürekli olmuş ve buna imkan doğan Şubat devrimi sonrasında Müftü Bayazidov görevden alınarak seçim yoluyla Alimcan Barudi Müftü olmuştur. Bu hamle müftülüğün Rusya Müslümanlarının dini ve kültürel hayatın hala merkezi konumunu koruduğunun en açık kanıtıdır.

THE ORENBURG MUSLİM SPİRİTUAL ASSEMBLY BETWEEN THE RUSSİAN REVOLUTİONS (1905–1917)

Our study examines whether there was a meaningful transformation in the religious and cultural rights of the Muslim population in the Russian Empire between the autocratic and constitutional (post-1905) periods. To address this question, the activities of the Orenburg Muslim Spiritual Assembly between 1905 and 1917 have been analyzed as an illustrative case. The findings demonstrate that when the Tsarist government conveyed its policies through the Muftiate without taking into account the sensitivities of the Muslim population, it generated considerable public discontent. At the same time, the muftis proved to be highly responsive to public opinion and social pressure. As the highest religious authority overseeing the Muslim clergy, the Muftiate enjoyed substantial legitimacy among the Muslim population. Its responsibility for supervising mosques, maktabs, madrasas, and the imams, teachers, and mudarris serving within these institutions further reinforced its moral and institutional authority.During the constitutional period, the Muslim population's aspiration to preserve its religious identity, cultural heritage, and faith while exercising greater influence over its own affairs became significantly more visible through the expansion of freedom of speech, the press, and public assembly. The Muftiate sought to strengthen its institutional position both within Muslim society and in its relations with the Tsarist administration. The 1905 Congress of the Ulama was convened as part of this broader effort. Nevertheless, the Tsarist bureaucracy adopted an increasingly restrictive attitude toward the principles of constitutionalism, a policy that was clearly reflected in the official meetings and administrative arrangements concerning the Orenburg Muslim Spiritual Assembly. Although a broad segment of the Muslim population strongly supported the convening of another congress in 1910, the authorities prevented it from taking place. Likewise, the consultative meeting held in Ufa in 1913 was conducted within an agenda and framework determined entirely by the Tsarist administration. The conference on the affairs of Russia's Muslims convened in the spring of 1914 was similarly dominated by Tsarist officials. In particular, the rejection of the elective principle in favor of the appointment of muftis directly contradicted the ideals and values of constitutional governance.Shortly after this meeting, the appointment of a mufti to the Orenburg Muslim Spiritual Assembly who lacked the confidence of the Muslim population brought relations between the Muftiate and the community to the verge of collapse. Efforts to remove Mufti Safa Bayazidov continued uninterrupted until the opportunity created by the February Revolution of 1917, when he was dismissed and replaced through an electoral process by Alimcan Barudi. This transition constitutes one of the clearest demonstrations that the Muftiate continued to occupy a central position in the religious and cultural life of the Muslims of the Russian Empire despite the profound political transformations of the period.
