Although the Theological School of Halki which was established on the Hill of Hope on Heybeliada in 1844 had gone under Turkish sovereignty following the conquest of İstanbul, this school acted under the direct of control and interest of the Greek Orthodox Patriarchate of İstanbul which the presence was saved by the Otoman Empire. The Theological School of Halki which was closed since 1971, turned out to be a main institutional issue which is the subject of political, legal and cultural disputes and developments, particularly after 1971. Even this issue gained an international status in which the US and the EU recently envolved. The aim of this paper is to analyze and reveal legally its impacts and status regarding Greco-Turkish problems relations with the Greek Orthodox Patriarchate of İstanbul from past to present and policy which the Republic of Turkey, primarily as an law state, could apply regarding the future of the Theological School of Halki inconsistency of thesis of Greece in this respect, who wants to expand her sovereign rights that are transfered by the Greek Orthodox Patriarchate of İstanbul.
