Nehyin Muktezası: Yasaklanan Fiilin Hükmü ve Hukukî Sonuç Doğurması

Müctehidler, nehiy sığasının yasaklanan fiilden hemen el çekmeyi gerektirdiği hususunda fikir birliği etmekle birlikte yasaklanan fiilin hükmü ve bu yasağa rağmen gerçekleşen fiilin geçerli olup olmayacağı hususunda ihtilaf etmişlerdir. Nehyin muktezasına ilişkin olan bu ihtilaf, yasağın fiilin zâtına mı yoksa vasfına mı yönelik olduğu tartışması kadar yasaklanan fiilin muâmelâttan mı yoksa ibadetten mi olduğu tartışmasıyla da yakından ilgilidir. Bu araştırma, nehiy konusunun bu boyutunu ele almayı hedef edinmektedir.

Required Meaning of Prohibition: Legal Status of Prohibited Act and It’s Bring Legal Consequence

Although the presence of consensus about the fact the capacities of prohibitions necessitate to withdraw from the prohibited act immediately, muctehids (reverends who create legal precedents) had a dispute whether it is valid or not while the prohibited act is processed by the man. It also became effective on the basis of the dispute whether the prohibited act is from muâmelât (transactions) or from worships as well as the reason of capacities of prohibition in other words the discussion whether the prohibited act is towards the personality or quality. We will also present the subject dimension of the impact of prohibition on provisions in this notification.
