Mudarabah As An Alternatıve To Interest

Abstract

People's individual and social welfare is possible by following the orders, prohibitions, policies, and principles set by Islam. A person who maintains his life within this framework will be comfortable in this world and happy in the hereafter. Interest is also among the things prohibited by Islam. To the extent that people comply with the aforementioned prohibition, their social, family, and legal lives will prosper, especially their economic activities. However, people need to have valid practices that they can substitute for when they avoid interest. Musharakah and Murabaha agreements, especially mudarabah, are practices that can replace interest. Each of these applications is discussed in the literature of Islamic law, and their elements and conditions are included. It is possible to adapt these applications to today's conditions due to their flexible features in their elements and conditions. In this study, the mudarabah contract, which is one of the practices in question, is discussed, the elements and conditions of this contract are briefly mentioned, then the differences between mudarabah and interest-bearing activities are given, and the possibility of mudarabah application as an alternative to interest is underlined. At the end of the study, the provision of movable documents known as mudarabah Sukuk used in today's conditions has been pointed out.
