Azmettirme, şerikliğin bir türü olarak, suç işleme kararına sahip olmayan bir kimseyi suça ikna etmeyi ifade eder. Failin hâlihazırda zaten bu suçu işleme kararı söz konusu ise (omnimodo facturus) bu durumda artık failin azmettirilebilmesi mümkün değildir. Ancak yardım etmenin koşulları araştırılmalıdır. Çalışmada hâlihazırda bir suç işlemeye karar vermiş kimseyi, ilk suçun temel veya nitelikli hâline ya da tamamen farklı bir suça ikna etme hâlinde hukukî sorumluluğun ne olacağı incelenmiştir. Bu çerçevede nitelikli hâl teorisi esas alınarak, yeni fiilin, failin ilk karar kıldığından farklı bir tipiklik unsuru içerip içermemesi kriteri çerçevesinde ulaşılan sonuçlara yer verilmiştir.

As a sort of complicity, instigation refers to persuading someone who does not have the decision yet to commit the crime. If the perpetrator has already determined to commit the crime (omnimodo facturus), (s)he cannot be instigated to conduct this same crime. However, the conditions of abetting (mental assisting) must be investigated. The legal responsibility of convincing someone who has already decided to commit a crime to the basic or qualified form of the original crime or to an entirely new crime was investigated in this study. Based on the qualified components theory, the findings have been reported that reached within the context of the criteria of whether the typicality of the new conduct contains any distinguishing element other than the perpetrator's original decision.
