Adultery, which has been described as an ugly, haram, sin and immoral act in
the eyes of societies, has been punished in various ways throughout the history. Penalties for
adultery crimes vary according to the law of societies and morality of societies. Some societies
have only condemned these adulterous, while others have punished them with the greatest
punishment that can be given. In the Ottoman Empire, the crime of adultery, which is described
as an action against the public morality, has been punished in accordance with the provisions
of şer’i and örfi laws. With the new criminal law in the 19th century, the penalties imposed
on adultery were relatively changed. However, the implementation of religious provisions was
continued due to the fact that şer’i courts continued their duties. In addition, “the woman who
committed adultery and evil must have been killed related” this fetva applyed. to the relatives
who saw the woman and his accomplice in adultery and killed him, şer’i law and code don’t
punishment. Therefore, today’s murders, called honor killings, have become happened in the
Ottoman Empire, which dominated a wide geography.
