The common practice "CP 9" has been adopted by the European Union Intellectual Property Network (EUIPN) in April 2020 in order to be implemented about some three-dimensional marks. In the introduction part of this study, the emergence of the mentioned common practice, its meaning, scope and importance in terms of European Union (EU) trade mark law and the possible effect of this common practice principles in terms of Turkish trade mark law tried to be explained. After this introduction, based on the examples and explanations in aforementioned common practice text, general principles created by considering the issues pointed out in the decisions of the European Court of Justice (CJEU) on some three-dimensional trademarks will be evaluated. One of the objectives of Industrial Property Code (IPC) numbered 6769 is to ensure harmonization with EU legislations and considering that the regulations of IPC related to trademarks have been prepared in the light of the EU trade mark regulations, applicability of the principles of this common practice to Turkish trade mark law will also be explained. There is no doubt about its ability to be applied to Turkish trade mark law, therefore, this study has been written with the idea that general principles created especially with the examples given in the text is eligible to be considered as a guide for Turkish practitioners about three-dimensional brands.
