The ability of a design to benefit from the legal protection stipulated under the Industrial Property Code no. 6769 depends on its novel and individual character. The scope of the protection gained by a design with these qualities is also determined in direct proportion to the individual character. In both situation, assessment of individual character is carried out on the basis of informed user opinion. It can be said that since most of the design law disputes are related to individuality, the informed user is a person who is in a decisive position in their resolution. In spite of that, there is no provision regarding the scope and content of the concept of informed user in the Intellectual Property Code no. 6769 or its source European Union legislation. In this direction, within the scope of the study, firstly the concept of informed user; its occurrence, functions and legal regulations which it is the subject are addressed. Subsequently, a definition is put forward within the framework of the elements that make up the concept and the definitions made in doctrine and practice. Finally, the main characteristics of the informed user and the differences between the concepts of "average consumer" and "expert" used as criteria in their interpretation are examined.
