As a rule, foreigners who intend to stay in Turkey longer than the visa duration and the visa exemption period must obtain a residence permit. Regulations regarding the residence permit are included in the Act on Foreigners and International Protection (YUKK) numbered 6458 and the Regulation on the Implementation of the Act on Foreigners and International Protection (YUKK Implementation Regulation). Foreigners who want to reside in Turkey within the scope of these regulations; short-term, family, long-term, student, humanitarian and human trafficking victims can reside in Turkey by obtaining one of the residence permits as issued. The YUKK and YUKK Implementing Regulations, which contain provisions regarding residence permits of foreigners, regulate in detail each type of residence permit, the conditions of the said residence permit, its extension or cancellation. However, despite these detailed regulations, it is seen that there are some contradictions or deficiencies in the said regulations. Moreover, it is noteworthy that some provisions are susceptible to misunderstanding or different interpretations. Undoubtedly, this contradiction or deficiency in the provisions regarding the residence right of foreigners or the provisions suitable for different interpretations may pose some problems in practice. The aim of this study is to draw attention to these problems related to the residence of foreigners within the scope of YUKK and YUKK Implementation Regulation and the solutions it offers. The study, which was prepared in line with this purpose, was prepared by taking the opinions of the public institutions and organizations where the studies on the subject were carried out.
