The marketing and advertising activity carried out by sharing the content created in order to guide the target group to purchase a particular product, on some people who have the power to influence a certain group in the virtual environments on their social media accounts is called influencer marketing. At the center of this activity is the influencer. The influencer’s activity is essentially based on an agreement with the customer. This contract can be defined as the contract in which the influencer commits to share the contents personally created or created by someone else, on his social media accounts in order to promote a particular goods or services and guide his followers to purchase them, and the customer commits to pay the influencer so fee or provide other benefits in return. The basic elements of the influencer contract are; promotion and advertising activity, use of social media, the influencer's independence from the customer's organization, and the payment of a price or other benefit to the influencer. The contract is different from sponsorship and advertising contracts; it is possible that the parties structure the influencer contract as an agency contract or contract of work but as a rule it is an innominate contract. The essential contractual obligations are to share promotional content on social media, to use advertising labels in posts, to act in accordance with the prohibition of competition and to carry out their activities with loyalty and diligence, for the influencer, and to pay for the influencer’s activities, for the customer.
