COMPETENCE OF TURKEY IN CASE OF CONSIDERING HERSELF TO BE THREATENED WITH IMMINENT DANGER OF WAR UNDER THE MONTREUX CONVENTION
Öz
The goal of this article is to determine that Turkey’s discretionary competence in cases
where Turkey considers itself to be threatened with imminent danger of war under the
Montreux Convention. If Turkey considers itself to be threatened with imminent danger
of war, the transit of war ships through the Straits is left to the discretion of the Turkey. In
same circumstances, merchant ships continue to enjoy transit rights, although they must enter in daylight and comply with traffic separation schemes and mandatory pilotage
established by Turkey. When Turkey declares it is under such circumstances, it is obliged
under the Convention to inform High Contracting Parties and Secretary-General of the
League of Nations (LN). If the Council of LN decide by a majority of two-thirds that the
measures thus taken by Turkey are not justified, and if such should also be the opinion
of the majority of the High Contracting Parties, Turkey undertakes to discontinue the
measures in question. Because of dissolution of LN at 1946, in this study it will be also
discussed whether transfer the powers of LN in the MC to the United Nations under the
concept of succession.
