Summary Dismissal Procedure Within the ICSID Arbitration

By way of summary dismissal procedure which is definedunder Rule 41/5 of the ICSID Arbitration Rules, a partymay, nolaterthan 30 days after of the Tribunal, and in any event before the first session of the Tribunal, file an objection that a claim is manifestly without legal merit. Thus, frivolous claims can be dismissed by the tribunal at the outset of the proceeding and consequently the parties save costand time. Application of summary dismissal procedure to ICSID cases has increased considerably in recent years and also other arbitration institutions have begun to introduce their expedited procedures to dismiss claims summarily in a similar manner. This article provides an overview of summary dismissal procedurewithin the ICSID arbitration by examining of Rule 41/5 of the ICSID Arbitration Rules in the light of the decisions given by tribunals.

ICSID Tahkiminde Hızlandırılmış Muhakeme Usulü

Öz

ICSID Tahkim Kuralları madde 41/5 ile tanımlanan hızlandırılmış muhakeme usulü ile taraflar, hakem kurulunun oluşumundan sonraki 30 gün içerisinde ve her halükarda ilk oturumdan önce bir iddianın açıkça hukuki dayanaktan yoksun olduğuna dair itirazda bulunabilmektedir. Böylelikle mesnetsiz iddialar, hakem kurulu tarafından yargılamanın başlangıcında reddedilebilmekte, taraflar da zamandan ve masraftan tasarruf etmektedirler. ICSID bünyesinde görülen tahkim davalarında usulün kullanımı son yıllarda oldukça artmış olup, farklı kurumsal tahkim merkezleri de tahkim kurallarında hızlandırılmış muhakeme usulünü benimsemeye başlamışlardır. Çalışmamızda, hakem kurulları tarafından verilen kararlar ışığında ICSID Tahkim Kuralları madde 41/5 incelenerek, ICSID tahkiminde hızlandırılmış muhakeme usulü değerlendirilmiştir.
