River Banks and Coastal Law in The Geomorphological Perspective

Abstract

The river banks are the current landforms, which are in the natural active bed of the river. They are affected and shaped by the morphodynamic processes of the moving water body of the river. A part of the river bank is underwater, but the other part is out. The river bank is defined by its borders except for the flood area. River banks contain evidence of geomorphological, hydrographic, hydrological, sedimentological, plant and soil characteristics shaped under the control of current fluvial processes. The distribution areas of this evidence represent the river banks. The outer border of the river banks is the river bank lines. The river shoreline is the line formed by combining the points where the river’s waters come into contact with the river bed. A river has shorelines and two bank lines. The river bank lines can vary among three different heights, which are low water level, normal water level, and high water level. The need for more scientific content on the protection and usage conditions of the river banks, as well as the dangers and risks of the river banks, in which the river banks, bank elements, and bank sections are defined in the current legal legislation, draws attention. This study aimed to discuss the deficiencies and contradictions in the current legal legislation with the main lines by making the geomorphological definitions of the river banks and parts of the river banks. Geomorphological evidence observations and measurements of river bank definition, bank sections, and boundary features were made on the samples of narrow-low bank and wide-low bank types within different tributaries of the Maritsa and Sakarya rivers. River bank features based on observations and measurements results have been generalized. In addition, the findings were used to examine the currently used river bank legislation. It is noteworthy that there are significant deficiencies and contradictory contents in the current legislation on river banks. This situation may cause problems in practice and social life, as well as cause confusion and erroneous evaluations in solving issues in legal proceedings. Depending on the river’s water levels, the Nearshore, foreshore, and backshore sections can be defined on the banks of a river. The river’s high water level represents the maximum length limit of the riverbed wetted perimeter. This boundary also forms the river bank line. This boundary is also the river bank line. The flood water level of the river and the corresponding flood area are not river bank elements.
