İmam Kâsânî ve “Bedâi’u’s-Sanâi” Adlı Eseri Üzerine Metodolojik Bir İnceleme

Today, the prominent scholars and the major schools of Islamic law have been intensively focused on with respect to the irunderstanding of legal matters. It is an obvious fact that since the era of mujtahid (diligent) scholars, there have been miscellaneous approaches by numerous scholars towards the comprehension of the Islamic law. Studies of this nature are of great importance due to that they cast light over both the present day and the tradition. This article aims at the manifestation of the general approaches of al-Qasani, who is a major figure in the Hanafite thought of Islamic law, to the understanding and assessment of the Hanafite school. Knowledge of the approach adopted by such scholar still deserve an attentive look, owing to it shigh significance level. The article thusendeavours to ascertain which criteria al-Qasani had followed in the understanding and assessment process of the substantive law (furu al-fiqh) with examples from his book, al-Badai al-Sanai. Finally the study shows the significance of the mentioned book through the legal opinions of al-Qasani.

Geçen tarihi süreçte iz bırakan âlimlerin ve ekollerin fıkıh anlayışlarının günümüz fıkıh araştırmalarında yoğun olarak konu edinildiği görülmektedir. Müçtehit imamlar döneminden itibaren yoğun bir şekilde değişik âlim ve mezhepler tarafından fıkhı anlamada farklı yaklaşımlar ortaya konduğu bilinmektedir. Bu tür araştırmalar, hem geleneği anlamak hem de günümüze ışık tutmak açısından büyük bir ehemmiyet taşımaktadır. Bu düşünceden hareketle makalemiz, Hanefî fıkıh düşüncesinin önde gelen şahsiyetlerinden, önemli görüş ve değerlendirmelere sahip bir âlim ve fakîh olan Kâsânî’nin, Bedâ’i’u’s-sanâ’i’ adlı eserini anlama ve bu eserde sergilediği temel yaklaşımları ortaya koymayı amaçlamaktadır. Bu çalışmada Kâsânî’nin hangi kıstasları esas alarak füru-ı fıkhı anlama ve değerlendirmede bulunduğu tespit edilmeye çalışılmıştır. Kâsânî’nin temel yaklaşımlarını ortaya koymak amacıyla eserinden seçtiğimiz örneklere, tespitlere ve değerlendirmelere yer vermeye çalışıldı
