Adalet Nedir?

The most fundamental issue tackled in Hans Kelsen’s (d. 1973) What is Justice? is the question of the absoluteness or relativity of justice. In/Within this framework, the author seeks answers to the following questions: Is absolute justice possible? If so, how can it be achieved? If it is not possible, can the pursuit of relative justice rather than absolute justice reduce the negative consequences of the problems thought to be caused by 'injustice'? Kelsen’s attempts to answer these questions make this work a study that cannot be ignored by anyone concerned with justice and the question of what justice is.

Hans Kelsen’in (ö. 1973) Adalet Nedir? başlıklı eserinde incelenen en temel mesele adaletin mutlaklığı yahut göreceliliği meselesidir. Yazar bu çerçevede şu sorulara yanıt aramaktadır: Mutlak adalet mümkün müdür? Eğer mümkün ise bu nasıl gerçekleştirilebilir? Şayet mümkün değil ise mutlak yerine göreceli bir adaletin peşinden koşmak “adaletsizlik”ten kaynaklı olduğu düşünülen problemlerin doğurduğu olumsuz sonuçları azaltabilir mi? Kelsen’in bu soruları yanıtlamak üzere yaptığı soruşturmalar eseri adalet üzerine çalışanların ve adalet nedir sorusunun peşinde koşanların bigane kalamayacağı bir incelemeye dönüştürmektedir.
