Evaluation of Extraordinary Rendition in Terrorist Crimes in the Context of Human Rights

In this study, ‘extraordinary rendition’ has been evaluated in the context of human rights. The basis of the study is the question ‘Is extraordinary rendition contrary to human rights?’ The aim of the study is to reveal that extraordinary rendition is contrary to human rights. Thus, the answer and conclusion to the question of how ordinary rendition can be made will be reached. In the study, qualitative research method was used. In this context; In the first part of the study, the definition of extraordinary rendition, its emergence and the content of its legal basis (the content of the Memorandum of Notification document) are discussed and examined. In the second part of the study, a case example of extraordinary rendition is presented. The exemplary case is the 'El Masri Case' heard in the European Court of Human Rights. In this case; the experiences of El Masri, who was a victim, were discussed in the context of the ‘prohibition of torture’ regulated in Article 3 of the European Convention on Human Rights and the ‘right to liberty and security’ regulated in Article 5 of the European Convention on Human Rights. While discussing the relevant case, the human rights principles determined by the European Court of Human Rights regarding the ‘prohibition of torture’ and the ‘right to liberty and security’ were determined. These identified principles were applied to the El Masri case. In the conclusion part of the study, how ordinary rendition can be done in accordance with human rights is discussed with the data obtained in the previous part (second part).

Terör Suçlarında Olağandışı Teslimin İnsan Hakları Bağlamında Değerlendirilmesi

Bu çalışmada, ‘olağandışı teslim’ insan hakları bağlamında değerlendirilmiştir. Çalışmanın temelini; ‘Olağandışı teslim, insan haklarına aykırı mıdır?’ sorusu oluşturmaktadır. Çalışmanın amacı, olağandışı teslimin insan haklarına aykırı olduğunu ortaya koymaktır. Böylece olağan teslimin nasıl yapılabileceği sorusunun yanıtına ve sonucuna ulaşılacaktır. Çalışmada, nitel araştırma yöntemi kullanılmıştır. Bu bağlamda; çalışmanın birinci bölümünde, olağandışı teslimin tanımı, ortaya çıkışı ve yasal dayanağının içeriği (Memorandum of Notification belgesinin içeriği) ele alınıp irdelenmiştir. Çalışmanın ikinci bölümünde, olağandışı teslime ilişkin bir adet vaka örneği sunulmuştur. Örnek vaka, Avrupa İnsan Hakları Mahkemesinde görülen ‘El Masri Davası’dır. Bu davada; mağdur konumunda bulunan El Masri’nin yaşadıkları, Avrupa İnsan Hakları Sözleşmesi’nin 3. maddesinde düzenlenen ‘işkence yasağı’ ve Avrupa İnsan Hakları Sözleşmesi’nin 5. maddesinde düzenlenen ‘özgürlük ve güvenlik hakkı’ bağlamında ele alınmıştır. İlgili vaka ele alınırken, Avrupa İnsan Hakları Mahkemesinin ‘işkence yasağı’ ile ‘özgürlük ve güvenlik hakkına’ ilişkin belirlediği insan hakları ilkeleri tespit edilmiştir. Tespit edilen bu ilkeler, El Masri vakasına uygulanmıştır. Çalışmanın sonuç bölümündeyse, daha önceki bölümde (ikinci bölüm) elde edilen verilerle, olağan teslimin insan haklarına uygun biçimde nasıl yapılabileceği tartışılmıştır.
