1952 Tarihli Roma Konvansiyonu ile 2009 Tarihli Genel Tehlike Konvansiyonu’nun Sorumluluk Hukuku Açısından Karşılaştırılması

Öz

Hava aracının yeryüzünde neden olduğu zararların nasıl karşılanması gerektiği hususu, hava araçlarının yaygın olarak kullanılmaya başlanmasından beri gündemde olan bir konudur. Bu konuda her devletin iç hukukunda düzenlenme bulunmakla birlikte uluslararası düzlemde ortak bir düzenleme sağlama isteği de mevcuttur. Günümüze kadar olan gelişmeler dikkate alındığında uluslararası boyutta çoğunluk açısından kabul görmüş uluslararası bir metnin varlığından bahsetmek mümkün değildir. Çalışmamızda, bu alanda ortaya çıkan son Konvansiyon metni ile 1952 tarihli Roma Konvansiyonu hükümleri sorumluluk hukuku açısından karşılaştırılacaktır.
