Legal Review of New Weapons as Foreseen by International Humanitarian Law

This study examines the legal review of weapons, as regulated by Article 36 of Additional Protocol I (AP I). This article obligates its Parties to determine if the employment of a new weapon, means, or method of warfare would be prohibited by international law. The primary aim is to prevent the deployment of weapons incompatible with humanitarian law at an early stage. The scope of this review is comprehensive, encompassing all phases from study and development to acquisition or adoption of a weapon system. It applies to all types of weapons, not exclusively high-tech ones, and assesses the normal and expected use of the weapon, rather than specific tactical applications during armed conflicts, which fall under other humanitarian regulations. Although Article 36 is a treaty provision, the paper argues for its evolution into customary international law, potentially binding states not party to the Protocol. Legal yardsticks for the review include IHL rules (both treaty and customary) and, human rights law, considering foreseeable future uses in various conflict types or law enforcement.
