The relapsing of the tribal manners after the Prophet’s death prevented that political system supported with scientific criterions. This situation caused of the chaos to be lived in Islamic society. Abû Hanîfa even was one of the men suffering annoyances of wrong politics. Racist Umayyad didn’t act with fairness towards Mavali new rightly guided in social, economic, and religious subjects. This situation caused Abû Hanîfa to be directed towards defensing the political and the legal rights of Mavali. Abû Hanîfa who regards the rights of Mavali as equal with the basics of Islamic religion pronounced the fatwas supporting the combats of Ali’s children towards the racist Umayyad and Abbasid. Traditionists (Muhaddisûn) dominated in the religious understanding of Ahl al-Sunna coming nowdays. They prefered the reconciliation unsuitable with rules of the religion ans science, but Abû Hanîfa didn’t identify himself with the political understanding isolated from the religious and scientific rules of justice, equality, and freedom, besides he insisted on the Caliphes of Umayyad and Abbasid going beyond the human rights.

Bu karıüıklık, toplumun bütün alanlarını etkilemiü, siyaset- le ilgisi olan da olmayan da bu kaostan nasibini almıütır. Sıffîn sava- üından sonra Müslüman Arap toplumu pek çok siyasi gruplara ayrılır- ken, hilafet hiç kimsenin dini hakkı olmadıùı halde insanlar, bu siyasi gruplardan her biri hakkında hissî ve kabilevî sebeplerle lehte ya da aleyhte fetvalar vermiülerdir. Çünkü baülangıçta veya daha sonra Hz. Peygamber’in hadisi gereùi “müminlerin üartlarına baùlı kalacaùı”4 bir siyasi sistem kurulamamıü ve bu bu siyasî belirsizliùin doùurduùu top- lumsal buhranı hayatı boyunca yaüayanlardan birisi de Ebû Hanîfe olmuütur
