Öz

AB’de karar alma süreci AB Komisyonu, AB Parlamentosu, Bakanlar Konseyi, Adalet Divanı, Bölgeler Komitesi gibi kuruluşlar ve uzman gruplardan oluşan büyük bir kurumsal sistem tarafından yürütülmektedir. AB kurumlarına birçok komite ve uzman grupları tarafından destek verilmektedir. Bu komisyonlar Avrupa Komisyon’un uygulamaya yönelik önerilerine görüş bildirmekte veya onaylamaktadırlar. Bu yönteme Komitoloji Prosedürü denilmektedir. AB için Komitoloji Prosedürü çok önem taşımaktadır.
AB’liği, kuruluşundan şimdiye kadar devam eden tarihsel süreçte çeşitli antlaşmalarla meşruluğu (demokrasiyi) karar verme sürecine daha fazla katmaya çalışmaktadır. Bunun yanında güçsüz bir yürütmenin, (Avrupa Konseyi, Avrupa Komisyonu) ise AB’nin dinamizmini etkileyeceğini düşünmektedir. Bu kapsamda; AB’de Komitoloji Prosedürü demokratikle, üçlü yürütme dengesini kurma isteğinin sağlandığı alandır. Bu makalede AB’de Komitoloji Prosedürünü anlatmak maksadıyla kapsamlı bir literatür taraması yapılımış ve nitel veriler metodolojik bir şekilde toplanmıştır. AB’de Komitoloji Prosedürünü açıklamak ve ortaya koymak maksadıyla sırasıyla AB’de Komitoloji, Geliştirilmiş İşbirliği, Uluslararası Antlaşmaların Yapım Süreci konuları işlenmiştir.

COMITOLOGY PROCEDURE IN THE EU

Öz

The decision-making process in the EU is carried out by a large institutional system consisting of institutions such as the EU Commission, the EU Parliament, the Council of Ministers, the Court of Justice, the Committee of the Regions and expert groups. In this context, EU institutions are supported by many committees and expert groups. These committees give their opinions or approve the implementation proposals of the European Commission. This method is called the Comitology Procedure. The Comitology Procedure is very important for the EU.
The EU has been trying to add legitimacy (democracy) to the decision-making process more with various agreements throughout the historical process from its establishment to the present. In addition, it thinks that a weak executive (European Council, European Commission) will affect the dynamism of the EU. In this context; the Comitology Procedure in the EU is the area where the desire to establish a balance between democracy and the tripartite executive is embodied. In this article, a comprehensive literature review was conducted and qualitative data was collected methodologically in order to explain the Comitology Procedure in the EU. In order to explain and present the Comitology Procedure in the EU, the subjects of Comitology in the EU, Enhanced Cooperation, and the Process of Making International Agreements were discussed, respectively.
