THE REFORM ACTIONS IN THE USA COMPETITIONLAW POLICIES

Öz

“Antitrust Modernization Commission” established in 2002 with the “Antitrust Modernization Commission Act” for the purpose of accomplishing essantial reform in the American competition law system. Commission, in the sense of make a correct antitrust analysis especially in the sectors such as communication, information and telecominication which are arising in the new economy, made a detailed study on the reforms which should be bounden in the current USA competition law policy. After, Commission has presented its opinion and offers to the Congress as a report in the 2007. In this study, it will be examined the criticism and opinion about the report and the issues which are be under debate in the report like, the importance of antitrust law in the new economy, enforcement institutions and exercise processes, civil damages actions about breach of the antitrust law rules, exclusionary conducts and etc.

ABD REKABET HUKUKU POLİTİKASINDA REFORM ÇALIŞMALARI

Öz

Amerikan rekabet hukuku sisteminde köklü değişiklişler yapmak amacıyla, 2002’de “Antitröst Modernizsyon Komisyonu Kanunu” ile “Antitrust Modernizasyon Komisyonu” kurulmuştur. Komisyon, özellikle yeni ekonomide yıldızı parlayan, iletişim, enformasyon, telekominikasyon gibi sektörlerde doğru bir antitröst analizi yapılabilmesi bakımından, mevcut ABD rekabet hukuku politikasında yapılması gerekli reformlar üzerine ayrıntılı bir çalışma yapmıştır. Daha sonra Komisyon, görüş ve önerilerini 2007 yılında bir rapor halinde Kongre’ye sunmuştur. Çalışmada bu rapor kapsamında ele alınan, rekabet hukukunun yeni ekonomideki önemi, ABD rekabet hukuku kurallarını uygulayacak olan kurumlar ve uygulama süreçleri, rekabet hukuku kurallarının ihlal edilmesinden dolayı zarara uğrayan kişilerin açtık
