Ceza muhakemesinde şüpheliden tükürük örneğinin alınması CMK m. 75 f. 1’de düzenlenmiştir ve şüphelinin örneğin alınmasına “katlanma yükümlülüğü” olduğu kabul edilmektedir. Adı geçen düzenleme ve yükümlülük şüphelinin vücut bütünlüğünün korunmasına (Ay. m. 17 f. 1) ve kişinin kendini suçlamaya zorlanması yasağına (Ay. 38 f. 5) dair temel insan haklarıyla uyumludur. Aynı husus, direnen şüpheliden tükürük örneğinin zorla alınması (PVSK m. 16 f. 1) için de geçerlidir. Bu ana ilkeler ışığında Anayasa Mahkemesinin Sıtkı Güngör başvurusu kararı incelenmiş ve Mahkemenin değerlendirilmesindeki bazı eksikliklere dikkat çekilmiştir. Bunlar özellikle adı geçen “katlanma yükümlülüğünün” gerekçesi, somut olayda başvurucuya şüpheli sıfatının verilmesi ve CMK’da üçüncü kişilerin vücudundan örnek alınmasına dair kanun boşluğunu ilgilendirmektedir. Çalışmada, ayrıca kişinin kendini suçlamaya zorlanması yasağının kapsamının belirlenmesi bakımından önemli bir husus teşkil eden Ay. m. 38 f. 5 anlamında “delil gösterme” kavramının anlamı belirlenmeye çalışılmıştır.

Taking spit sample from suspect in criminal proceedings is regulated by in section 75(1) of Turkish Criminal Procedure Code and it is generally acknowledged that the suspect has an ‘obligation to bear’ of the sample being taken. The aforementioned regulation and obligation are in line with the fundamental human rights regarding the protection of the suspect’s body integrity (Article 17(1) of Turkish Constitution) and the prohibition of being forced to incriminate oneself (Article 35(8) of Turkish Constitution). The same is also valid for using of compulsion if the suspect resists to taking of sample (section 16(1) of Turkish Code of Police Duties and Powers). In the light of these main principles, the decision of the Constitutional Court in case of Sıtkı Güngör was examined by this article and some deficiencies in the evaluation of the Court were pointed out. These are particularly concerned with the justification of the ‘obligation to bear’, giving the applicant the status of suspect under circumstance of present case and taking samples from the body of a third person in accordance with Turkish Criminal Procedure Code. The article also deals with an important issue in determination of the scope of the prohibition of self-incrimination, namely the meaning of term of ‘showing evidence’ to which nobody may be compelled according to Article 38(5) of Turkish Constitution.
