The importance of personal data has come to the forefront with the development of information and communication
technologies and the spread of the internet. In particular, the illegal processing of health data, which are referred to
as “sensitive data”, may cause more serious harm to the person concerned than to other data. However, sharing
these information is a violation of right to private life, patient privacy right and the obligation of doctor - patient
confidentiality. The concern that personal health data is not adequately protected may cause patients to hesitate
to apply to health care facilities. This, in addition to the right to health, will mean more violation of the right to life.
In our study, the international regulations on the protection of personal data in general, in particular the “Personal
Health Data” and the regulations in our national legislation on the subject have been taken up in the light of the
implementation in our country. This study is based on literature.
