  • Because of the vital importance of banking to countries’ economy and the detri
  • mental effects of the fraudulent actions of bankers to the well being of a bank and its
  • systemic effect to the other banks in the market, regulators impose criminal sanctions.
  • In Turkey, a special embezzlement offence that can be conducted by bankers is regula
  • ted under article 160 of the Banking Law No.5411. This article aims to analyze this cont
  • roversial criminal offence within Banking Law No.5411, Turkish Criminal Law No.5237
  • and the abolished Banking Law No.4389. In this respect, the study includes general infor
  • mation about embezzlement, elements of the offence, special circumstances that affects
  • the nature of the offence, specific forms of the offence and prosecution methods. In addi
  • tion, recommendations regarding the time of crime and trial precondition are given, and
  • it is stated that, considering the problems in the banking sector as well as the heavy bur
  • den they place on the country’s economy, the penalties are proportional to the crime.
