Historical and Political Background of Exceptions to Member States in European Union Policies

Öz

The European Union, which is a supranational organization founded in 1952, has undergone many enlargement processes from its establishment. As a result of these enlargements, the need to deepen has emerged and new treaties changing the founding treaties have entered into force. The European Union member states generally accept the binding nature of European Union law. However, exceptions granted to certain member states lead to questioning whether the rules apply to all or not. Countries can make reservations in specific policy areas before membership takes place, and can indicate that they will not join a new policy area after membership. Is this a result of the nature of the European Union law, or is it a characteristic of these states themselves? This study aims to reveal the circumstances under which the exceptional countries in the European Union take these exceptions. By analyzing the causes of exceptions, contrary to the studies made by specifying only exceptions, the nature of the legal relationship between the Union and the member states and the binding of European Union law will be tried to be understood
