Öz

Bu makale, Avrupa Birliği'nin Dijital Tek Pazar Direktifi'nin, özellikle Madde 17 üzerine odaklanarak, detaylı bir incelemesini sunmaktadır. Direktifin ana amacı, telif hakkı sahiplerinin hakları ile internet kullanıcılarının özgürlükleri arasında bir denge kurmak iken, aynı zamanda Avrupa Birliği genelinde telif hakkı düzenlemelerini uyumlu hale getirmektir. Makale, Madde 17'nin uygulanmasındaki karmaşıklıkları, getirilen yükümlülüklerin temel haklar, özellikle ifade özgürlüğü hakkı, üzerindeki etkilerini ve Avrupa'nın dijital ekonomisi üzerindeki rolünü derinlemesine analiz etmektedir. Ayrıca, Avrupa Birliği üye devletlerinde Direktifin yerel hukuklarına geçiş sürecindeki çeşitliliği ve ortaya çıkan hukuki tartışmaları da ele alarak, Avrupa Birliği içindeki dijital telif hakları çerçevesine dair geniş bir anlayış sunmayı hedeflemektedir.

Öz

The article offers a comprehensive analysis of the Digital Single Market Directive of the European Union, with a specific emphasis on Article 17. The Directive aims to achieve the objectives of unifying copyright laws throughout the European Union while striking a balance between the interests of copyright owners and the rights of internet users. An in-depth analysis is conducted on the intricacies of implementing Article 17, its ramifications on fundamental rights, and its influence on the digital economy in Europe. The study also examines the various approaches used to implement the Directive in European Union member states and the legal debates it has sparked, therefore enhancing the comprehension of the digital copyright framework in the European Union.
