ULUSAL AZINLIKLARIN KORUNMASINA İLİŞKİN ÇERÇEVE SÖZLEŞMESİNİN KOSOVA’DA UYGULANMASI

Bu çalışmada “Ulusal Azınlıkların Korunmasına İlişkin Çerçeve Sözleşmesi”nin Kosova’da uygulanması incelenmiştir. Bu çalışmanın amacı henüz uluslararası alanda tanınmayan Kosova Cumhuriyetinin sahip olduğu kendine özgü statüde azınlık haklarını korumak amacıyla yaptığı düzenlemelerin ve “Ulusal Azınlıkların Korunmasına İlişkin Çerçeve Sözleşmesi”nin Kosova’da uygulanmasının incelenmesidir. Çalışmada ilk olarak Kosova’nın yakın tarihi ve Kosova’da azınlık haklarının önemi incelenmiştir. İkinci olarak Kosova’nın azınlıklara yönelik politikası ve azınlık haklarını uygulaması sürecinde kullandığı kendine özgü metotlar incelenmiştir. Zira Kosova henüz uluslararası alanda tam tanınma sağlayamadığı için süreç ve içerik açısından uniqe bir yapıya sahiptir. Bu nedenle üçüncü olarak Kosova’da azınlık haklarının gelişimi incelenmiştir. Dördüncü olarak, özellikle uluslararası azınlık hakları standartlarının ve belgelerin, Kosova anayasa ve yerel yasalara dâhil edilmesi ve “Ulusal Azınlıkların Korunmasına İlişkin Çerçeve Sözleşmesi”nin anayasallaştırılması incelenmiştir. Son olarak, Kosova’nın devlet inşa sürecinin devam etmesi, varsayılan devlet olma koşullarına sahip olmaması ve uluslararası hukukun egemen bir aktörü olma konusunda henüz gerekli şartların oluşmaması nedeniyle “Ulusal Azınlıkların Korunmasına İlişkin Çerçeve Sözleşmesi”nin uygulanması konusunda Kosova’da uygulanan yöntem incelenmiştir.

In this study, the implementation of the "Framework Convention for the Protection of National Minorities" in Kosovo has been examined. The aim of this study is to examine the regulations made by the Republic of Kosovo, which is not yet internationally recognized, in order to protect the minority rights in its unique status and the implementation of the "Framework Convention on the Protection of National Minorities" in Kosovo. In the study, first of all, the recent history of Kosovo and the importance of minority rights in Kosovo were examined. Secondly, Kosovo's policy towards minorities and the unique methods used in the implementation of minority rights are examined. Since Kosovo has not yet achieved full international recognition, it has a unique structure in terms of process and content. Therefore, thirdly, the development of minority rights in Kosovo is examined. Fourthly, the inclusion of international minority rights standards and documents in the Kosovo constitution and local laws and the constitutionalization of the “Framework Convention for the Protection of National Minorities” were examined. Finally, since the feature of being a sovereign actor of international law has not yet been met, the method applied in Kosovo for the implementation of the “Framework for the Protection of National Minorities” was examined
