AN ANALYSIS ON THE PRESIDENTIAL SYSTEM PROPOSED
JUSTICE AND DEVELOPMENT PARTY
Öz
The presidential system discussions, for the first time begin with Ozal and
continued with Demirel, have been raised again by the Justice and Development
Party in parallel to the discussion of the Civil Constitution. In this context the
presidential system, presented as a new model to Constitutional Reconciliation
Commission, is suggested as an alternative to parliamentary system. The system is
discussed via specific parameters in public of Turkey, adopted the parliamentary
system in 1909 and has a hundred years of parliamentary democracy experience
and reached a certain maturity despite some flaws in the application. The study
aims to search the debates as follows; how to achieve the separation of the forces
in theory and practice with Presidential system, and on this basis how to
implement the mechanisms of checks and balances, compatibility of the political
party system to evolve in the presidential system in Turkey, where party discipline
is valid, whether to create wardship over judicial bodies of the President’s on
one’s own assignments of senior public officials (ambassador, senior bureaucrats)
and in particular the judicial organs (Constitutional Court, the Council of Higher
Education, half of the members of the High Council of Judges and Prosecutors
and the Council of State) while the single legislature has no authority of
interpellation and vote of confidence over the president, whether the legislature to
become dysfunctional and ineffective with the President’s Decree, whether the
President to have absolute power over the legislature searching of the qualified
majority for the adoption of the laws of the legislature for the second time after
being vetoed by the President and the discussions of the impact of the authority of
terminating each other and renewing the elections at the same time of the
President and the legislature to the political system.

ADALET VE KALKINMA PARTİSİ’NİN ÖNERDİĞİ BAŞKANLIK SİSTEMİ ÜZERİNE BİR İNCELEME
Öz
Türkiye’de ilk defa Özal ile başlayan sonrasında Demirel ile devam eden
Başkanlık sistemi tartışmaları sivil anayasa tartışmalarına paralel olarak Adalet ve
Kalkınma Partisi tarafından tekrar gündeme getirilmiştir. Bu kapsamda Anayasa
Uzlaşma Komisyonuna yeni bir model önerisi şeklinde sunulan “Başkanlık
Sistemi’’ parlamenter sisteme alternatif olarak önerilmektedir. Söz konusu sistem,
1909’da parlamenter sistemi benimsemiş ve 100 yıllık Parlamenter demokrasi
tecrübesi olan ve uygulamada bazı aksaklıklarına rağmen belirli bir olgunluğa
erişmiş Türkiye’de kamuoyunda belirli parametreler üzerinden tartışılmaktadır.
Başkanlık sistemi ile kuvvetler ayrılığının teoride ve pratikte nasıl sağlanacağı ve
bu temelde denetim ve denge mekanizmalarının nasıl uygulanacağı, parti
disiplinin geçerli olduğu Türkiye’de siyasal parti sisteminin sisteme evrilmeye
ayak uydurabilirliği, tekli yasama organının başkanın üzerinde gensoru ve
güvenoyu yetkisi olmaz iken Başkanın yasama organının onayı olmaksızın üst
düzey kamu görevlilerini(Büyükelçi, üst düzey bürokratlar) ve özellikle yargı
organlarına tek başına yapacağı atamalar(Anayasa Mahkemesi, YÖK, HSYK ve
Danıştay üyelerinin yarısı) ile yargı organları üzerinde vesayet oluşturup
oluşturmayacağı, Başkanın yasa gücünde Başkanlık kararnamesi çıkarabilmesi ile
yasama organının işlevsiz hale gelip gelmeyeceği, yasama organının yaptığı
kanunların Başkan tarafından veto edildikten sonra ikinci defa kabulü için yasama
organında nitelikli çoğunluk aranmasının Başkanın yasama organı üzerinde
mutlak güç meydana getirip getirmeyeceği, Başkan ve yasama organının
birbirlerini feshetme ve aynı anda seçimlerle yenileyebilme yetkisinin siyasal
sistemde yaratacağı etki tartışmaları çalışmanın konusunu oluşturmaktadır.
