THE UNITED STATES OF AMERICA: COUNTRY THAT HAS NOT RATIFIED THE U.N. CONVENTION ON THE RIGHTS OF THE CHILD

Abstract

The United Nations (UN) Convention on the Rights of the Child, which entered into force in 1990, is the most widely accepted Convention among international human rights treaties. The United States of America took an active part in the preparation of the aforementioned Convention and took initiatives for other countries to sign and ratify the Convention. However, the United States is the only country out of all the UN member states (196 countries) that has not ratified the Convention. The USA continues its stance of not being a party to the Convention, despite its leading role in the preparation of the Convention and all the criticisms. This study presents the main arguments about why the USA is not a party to the aforementioned Convention, especially the allegations of harming the family institution and violating the right of parents to raise their children according to their own beliefs. To the best of our knowledge, this is the first study presenting these arguments to the Turkish public in a scientific manner.

ÇOCUK HAKLARI SÖZLEŞMESİNE TARAF OLMAYAN ÜLKE: AMERİKA BİRLEŞİK DEVLETLERİ

Öz

1990 yılında yürürlüğe giren Birleşmiş Milletler (BM) Çocuk Haklarına Dair Sözleşme, uluslararası insan hakları belgeleri arasında en yaygın kabul gören Sözleşme konumundadır. Amerika Birleşik Devletleri, mezkûr Sözleşmenin hazırlanmasında aktif olarak yer almış ve diğer ülkelerin Sözleşmeyi imzalaması ve onaylaması için girişimlerde bulunmuştur. Bununla birlikte, ABD, BM üyesi bütün ülkeler (196 ülke) içinde Sözleşmeye taraf olmayan tek ülkedir. ABD, Sözleşmenin hazırlanmasındaki öncü rolü ve yöneltilen bütün eleştirilere rağmen Sözleşmeye taraf olmama tutumunu sürdürmektedir. Aile kurumuna zarar verme ve ebeveynlerin çocuklarını kendi inançlarını göre yetiştirme hakkını ihlal etme iddiaları başta olmak üzere ABD’nin mezkûr Sözleşmeye neden taraf olmaması ile ilgili temel argümanların Türkiye kamuoyuna bilimsel anlamda ilk defa taşınıyor olması bu çalışmayı önemli kılmaktadır.
