ULUSLARARASI CEZA MAHKEMESİ’NİN NETANYAHU VE GALLANT HAKKINDAKİ TUTUKLAMA MÜZEKKERESİNİN HUKUKİ VE POLİTİK YANSIMALARI

Öz

Uluslararası Ceza Mahkemesi (UCM), evrensel ceza adaletini ve bireysel hesap verebilirliği sağlamak amacı ile kurulmuş olsa da bu amacı gerçekleştirmek noktasında yetersiz kalması iddiaları ile sıklıkla eleştirilmektedir. Kuruluşundan bu yana gerçekleştirdiği soruşturma ve yargılamalar, ilk bakışta Mahkemenin genellikle uluslararası politikalar ve devlet çıkarlarının etkisi altında kaldığını düşündürmektedir. Bu çalışma, UCM’nin amacını ve etkililiğini, İsrail Başbakanı Benjamin Netanyahu ve Savunma Bakanı Yoav Gallant hakkında çıkarılan tutuklama müzekkeresi ışığında analiz etmektedir. Bu analiz, UCM’nin işleyişinde hukuk ve politikanın ne ölçüde etkileşimde olduğu sorusuna eleştirel bir yaklaşım sunmayı amaçlamaktadır. Nihayetinde, UCM’nin tutuklama müzekkeresinin fiilen icrasının üye devletlerin siyasi ajandalarına göre şekillenen takdir yetkisine bırakılmış olması, her ne kadar Mahkemenin meşruiyeti ve etkililiğine ilişkin soruları beraberinde getirse de; bu adımın taraf devletlerin siyasi tutumları üzerinde olumlu etkiler yarattığına dair bulgular, UCM’nin evrensel adaletin gelişimindeki önemini koruduğu yönündeki argümanı desteklemektedir.

THE LEGAL AND POLITICAL IMPLICATIONS OF THE INTERNATIONAL CRIMINAL COURT’S ARREST WARRANT AGAINST NETANYAHU AND GALLANT

Öz

The International Criminal Court (ICC) was established to uphold criminal justice and individual accountability on a global scale. Yet, it has been critiqued for its ineffectiveness in realising its goals. This study examines the Court’s objectives and effectiveness in light of the ICC’s arrest warrant issued against Israel's Prime Minister, Benjamin Netanyahu and the former Minister of Defence of Israel, Yoav Gallant. By critically examining the interaction between law and politics in the ICC’s decisions, this article discusses the potential implications of this decision. While the ICC’s primary mission is to uphold international criminal justice, this paper argues that its decisions are often influenced by global politics and state interests. Netanyahu and Gallant’s actual arrest is left to the discretion of member states, whose compliance often aligns with their political agendas. Although this situation raises questions about the legitimacy and effectiveness of the Court, the findings of this research also show that the arrest warrant decision has had a positive effect on the political stances of some of the state parties. Thus, it supports the idea that ICC is still an important mechanism to improve universal jurisdiction.
