10 Yıla Yaklaşan Geçici Korumada Geçiciliğin Sonu ve Kalıcı Çözümler

Öz

Türk Yabancılar Hukuku’nda 28.04.2011 tarihinden itibaren kitlesel olarak sınırlarımıza gelenlerin başlangıçta geçici oldukları ve geri dönecekleri düşüncesiyle bir süre sınırı öngörülmeksizin uygulanan ve 10 yıla yaklaşan geçici koruma, uluslararası korumaya alternatif haline gelmiştir. Oysa geçici korumanın uzun sürmesi durumunda kalıcı çözümlerin uygulaması gerekir. Bu açıdan geçici korunanlara yönelik olarak, gönüllü geri dönüş, üçüncü ülkeye yerleştirme ve yerel entegrasyon kalıcı çözümlerinin birleşiminden oluşan bir program izlenmelidir. Kalıcı çözümlerden gönüllü geri dönüş ve üçüncü ülkeye yerleştirme sınırlı sayıda geçici korunan için uygulanabilir olduğundan, Türkiye açısından yerel entegrasyon kalıcı çözümüne ağırlık verilmesi gerekmektedir. Yerel entegrasyon bağlamında öncelikle geçici koruma uygulamasına son verilerek, uluslararası koruma statülerine geçiş imkanını sağlanmalı ve nihayetinde vatandaşlık verilmesi imkanı değerlendirilmelidir.

APPROACHING 10 YEARS: TOWARDS THE END OF TEMPORARY PROTECTION AND DURABLE SOLUTIONS

Öz

Temporary protection, which has been applied in the Turkish law of foreigners since 28 April 2011 without a time limit based on the idea that those who come to our borders are initially temporary and will return, and which is approaching its 10th year, has become an alternative to international protection. However, in case temporary protection lasts long, durable solutions must be applied. In our study, which examines voluntary repatriation, resettlement and local integration durable solutions for temporarily protected persons, it is concluded that a program consisting of a combination of durable solutions should be followed. Durable solutions of voluntary repatriation and resettlement is applicable to a limited number of those persons, Turkey should give weight to the durable solution of local integration. As a part of local integration, the temporary protection application should be terminated, the possibility of transition to international protection status should be provided and finally the possibility of naturalization should be evaluated.
