An Examination on Checks and Balances Mechanism in USA Presidential System

Öz

Presidential system one of the three main systems about governmental systems. These three systems can be defined according to positions of parliament and government. In this point, distance between parliament and government is main indicator in order to understand an essential feature of presidential systems. Presidential system have been implemented in USA science its foundation. On the other hand, governmental systems reflect their era’s condiditons. This concept is also valid for presidential systems. However, today there are so many debates in US presidential systems in terms of keeping checks and balances tools. These tools essentially invested in order to regulate relationship between Congre and President and force them to stay balanced framework in the system. Nevertheless, political culture can be expressed another factor which bases on compromise mentuality in terms of operating system. Although seperation of powers appears harshly in prrsidential system, Congress and President should work side by side in many situation. In fact that tools of checks and balances force them get together as well as political atmosphere. In this position, If tools of checks and balances and political atmosphere force them get together, president generally have more power than Congress. To illustrate, in the President G.W.Bush term Congress support substantially to President’s anti-terror policy. President G.W.Bush had got a serious fluence on Congress.Therefore, effectiveness of checks and balances tools can be changed according to different political atmosphere. In this point it can be said that operating the tools give us not same conlusion every time

ABD BAŞKANLIK SİSTEMİNDE FREN VE DENGE MEKANİZMASI ÜZERİNE BİR İNCELEME

Öz

Başkanlık sistemi hükümet sistemleri ile ilgili üç temel sistemden birisidir. Bu üç sistem parlamento ve yürütmenin konumlarına göre belirlenebilir. Bu noktada parlamento ve yürütme arasındaki mesafe başkanlık sisteminin temel özelliğini anlayabilmek için esaslı bir göstergedir. Başkanlık sistemi ABD’de devletin kuruluşundan bu yana uygulanmaktadır. Diğer yandan hükümet sistemleri devirlerinin şartlarını yansıtırlar. Bu durum başkanlık sistemi için de geçerlidir. Ancak günümüzde başkanlık sistemi konusunda fren ve denge araçlarının korunabilmesi bakımından pek çok tartışma yaşanmaktadır. Bu araçlar esasında kongre ve başkan arasındaki ilişkiyi düzenlemek ve onları sistemde dengeli bir çerçeve içerisinde kalmaya zorlamaktır. Bununla birlikte sistemi işletmek için uzlaşı anlayışına dayanan siyasi kültür, sistemin işletilmesi bakımından bir diğer faktör olarak ifade edilebilir. Başkanlık sisteminde kuvvetler ayrılığı şiddetli bir şekilde görünmesine rağmen, kongre ve başkan çoğu durumda yan yana olmak zorundadır. Aslında fren ve denge araçları, siyasi atmosferin yanı sıra onları bir arada olmaya zorlamaktadır. Bu durumda eğer fren ve denge araçları ve siyasi atmosfer onları bir arada olmaya zorlarsa başkan genellikle kongreden daha fazla güç sahibi olmaktadır. Örneğin Başkan G.W. Bush döneminde Kongre büyük oranda başkanın anti-terör politikalarını desteklemiştir. Bu nedenle fren ve denge araçlarının etkinliğinin farklı siyasi atmosfere göre değişebileceğini söyleyebiliriz. Bu noktada araçların işletilmesinin bize her zaman aynı sonucu vermeyeceği söylenebilir
