“Hearing” Power of Legislative Bodies and New Suggestions for Strengthening The GNAT

Öz

In terms of the relations and interaction between the legislative and executive branches, the way in which the principle of “separation of Powers” is adopted and implemented in the Constitution is decisive. In presidential systems based on a strict separation of powers, the functioning and updating of balancing and control mechanisms become more important. In line with the inevitable goal of strengthening the parliament in the face of a strong executive, the constitution, the rules of procedure of the GNAT and other laws related to parliamentary life need to be reformed. In this context, the power of “hearing”, which has been successfully implemented in parliaments around the world, needs to be introduced with new articles that do not require a constitutional amendment and can only be added to the GNAT Rules of Procedure.
Based on this requirement, this study aims to develop a model for the application of the “hearing” method, which exists in most legislative bodies regardless of the system of government, in the Turkish Grand National Assembly. Through a comparative study of the legal basis and established practices of the “hearing” method in different systems, such as the UK, the US, Germany, France, Hungary, Spain, Poland and the European Parliament, a proposal has been prepared on what kind of amendment to the Rules of Procedure specific to Turkey is required.
In the concluding part of the study, a draft proposal for the Rules of Procedure, consisting of three articles was prepared. The draft RP proposes three types of “hearing” powers for the Turkish Grand National Assembly. The first is related to the process of appointment of top-level public administrators by the executive branch, which can be found in almost all systems of government, including the US presidential system; the second is the permanent “hearing” power of the standing commissions in relation to their areas of responsibility. The third is a hearing for the purpose of “listening and monitoring” to be held at least once a year in the relevant standing commissions. The hearing to be held under the roof of the Parliament in terms of monitoring the implementation of laws, if successfully implemented, can become a mechanism that can be a good practice model from our country to the world parliaments.

YASAMA ORGANLARININ “BİLGİLENİM (HEARING)” YETKİSİ VE TBMM’NİN GÜÇLENDİRİLMESİ İÇİN YENİ ÖNERİLER

Öz

Yasama ve yürütme organı arasındaki ilişkiler ve etkileşim açısından Anayasada “kuvvetler ayrılığı” ilkesinin ne şekilde benimsendiği ve uygulandığı belirleyici bir nitelik taşır. Katı veya belirgin kuvvetler ayrılığının esas alındığı başkanlık sistemlerinde denge ve denetleme mekanizmalarının işlerliği ve güncellenmesi daha önemli hale gelmektedir. Güçlü yürütme karşısında kaçınılmaz olarak parlamentonun da güçlendirilmesi hedefi doğrultusunda Anayasa, TBMM İçtüzüğü ve parlamenter hayatla ilgili diğer kanunların reforma tabi tutulması gerekmektedir. Bu bağlamda, anayasa değişikliği gerektirmeyen sadece TBMM İçtüzüğüne eklenebilecek yeni maddelerle, dünya parlamentolarında başarıyla uygulanmakta olan “hearing” yetkisinin getirilmesi gerekmektedir.
Bu gereklilikten hareketle bu çalışmada hükümet sistemi fark etmeksizin neredeyse tüm yasama organlarında kullanılan bu önemli aracın TBMM’de de uygulanması için bir model geliştirilmesi amaçlanmıştır. İngiltere, ABD, Almanya, Fransa, Macaristan, İspanya, Polonya ve Avrupa Parlamentosu olmak üzere farklı sistemlerdeki hukuki dayanağını ve yerleşik uygulamalarını karşılaştırmalı biçimde inceleyerek Türkiye’ye özgü nasıl bir İçtüzük değişikliği gerektiği konusunda öneri hazırlanmıştır.
Çalışmanın Sonuç Kısmında, üç maddeden ibaret bir İçtüzük Değişikliği Teklifi taslağı hazırlanmıştır. İçtüzük Değişikliği Teklifi taslağında, TBMM için üç türlü “bilgilenim” yetkisi önerilmektedir. Bunların ilki ABD başkanlık sistemi de dahil tüm hükümet sistemlerinde görülen yürütme organının üst kademe kamu yöneticilerini ataması süreciyle ilgilidir; ikincisi, daimi komisyonların kendi görev alanlarıyla ilgili sürekli “bilgilenim” yetkisidir. Üçüncüsü ise, en az yılda bir defa ilgili daimi komisyonlarda düzenlenecek “dinleme ve izleme” amaçlı bilgilenimdir. Kanunların uygulamasını izleme anlamında parlamento çatısı altında gerçekleştirilecek bilgilenim, fiilen başarıyla uygulandığı takdirde, ülkemizden dünya parlamentolarına örnek uygulama modeli olabilecek bir mekanizma ortaya çıkabilir.
