Edictum Theodorici Regis’in Tarihsel ve Hukuki Kimliği

Öz

Ostrogot Kralı Büyük Theodoric tarafından ilan edilmesine rağmen, doğası gereği Roma hukukunun bir eseri olan Edictum Theodorici, 154 hüküm, bir ön söz ve bir de son sözden oluşan ve davaların niteliği ile cezai suçları içeren bir yasa kitabıdır. Theodoric’in hükümdarlığına bağlı çalışan Romalı hukukçular tarafından hazırlanan edict, temelde krala dek ulaşan anlaşmazlıklara son vermeyi ve krallıkta yeniden barış ortamının tesisini amaçlamaktadır. Kişisel hukuk, kölelik, mülkiyet, sözleşmeler, satışlar, vergiler, aile ve çeşitli suçlar gibi konuların temelini oluşturduğu edict’in içeriği, başlıktan bağımsız ve konu bütünlüğü çok az dikkate alınarak oluşturulmuştur. Orijinal metni günümüze ulaşmayan edict’in, ilk edisyonu Fransız hümanist Pierre Pithou’nun 1579 yılında yayınladığı eseri sayesinde tam metin halinde bugüne gelmeyi başarmıştır. Paulus, Ulpianus ve Papinianus’un hukuki metinleri, Codex Gregorianus, Codex Hermogenianus, Codex Theodosianus ile Marcianus, Severus ve Anthemius novellae’leri gibi Roma hukuk metinlerinin temelini oluşturduğu edict, hukuk konusunda eğitimli kimselerin ve bu kimselerin terminolojiye olan hakimiyetin azaldığı, yasal denetimin ve yargı kesinliğinin yitirildiği, bölgesel ihtiyaçları karşılamanın temel amaç olduğu veya klasik hukukun barbarlaşması gibi meydana gelen sosyal, idari ve hukuki değişimler ile Roma İmparatorluğu’ndan alınan mirası yansıtmaktadır.
