Palestine Occupation in Media and International Humanitarian Law

Öz

Occupied Palestine has been subjected to heavy counter-attacks by Israel Army after the attacks organized by Hamas on Israel on October 7, 2023, which has been occupied for more than fifty years. While occupation and blockade policies clearly indicate the crime of genocide and violations of international humanitarian law, media coverage on the question of legitimacy of Israeli military operations, the actions of Hamas, and the causes and consequences of the conflicts, effects the interpretation and consequences of positive law. During the occupation of Palestine, which has been going on since 1967, the way in which the violent acts carried out by state or non-state actors, which should be evaluated within the framework of international law and humanitarian law, are conveyed by media organs is important in terms of applying (or not) applying rule of international humanitarian law.

Medyada Filistin İşgali ve Uluslararası İnsancıl Hukuk

Öz

Elli yılı aşkın süredir işgal altında olan Filistin, 7 Ekim 2023 tarihinde Hamas’ın, İsrail ülkesinde düzenlediği saldırı sonrası İsrail askeri güçlerinin ağır karşı saldırılarına maruz kalmıştır. İsrail’in işgal ve abluka politikaları açıkça soykırım suçunu ve uluslararası insancıl hukuk ihlallerini işaret ederken, medya organlarının, İsrail askeri operasyonlarının meşruiyet sorunu, Hamas eylemleri ve Filistin’deki çatışmaların nedenleri ve sonuçları hakkında yer verdiği haberler pozitif hukuk kurallarının yorumlanması ve uygulanmasını etkilemektedir. 1967’den beri devam eden Filistin işgalinde, uluslararası hukuk ve bu minvalde insancıl hukuk çerçevesinde değerlendirilmesi gereken devlet ya da devlet dışı aktörlerin gerçekleştirdiği şiddet içeren eylemlerinin, medya unsurları tarafından aktarılma şekli, uluslararası insancıl hukukun uygulanma(ma)sı bakımından önem arz etmektedir.
