The Qadis as Representatives of Shar‘i Authority: Judicial Power and Administrative Responsibilities in the Great Seljuk State

Öz

In the Great Seljuk State, the maintenance of justice (ʿadl) and the provision of an equitable administration were regarded as the fundamental prerequisites for the state’s legitimacy (mashrūʿiyya) and its endurance. In this framework, the Sultan, as the ultimate head and guardian of all political and judicial institutions, delegated his judicial authority to the ḳāḍīs. Thus, the ḳāḍīs functioned as the judicial deputies (nāʾibs) of the Sultan, ensuring the application of sharʿī rulings and legal decisions (ḥukm). The office of the ḳāḍī in the Great Seljuk era functioned far beyond a strictly litigious and legal framework; it encompassed a broad spectrum of judicial, political, administrative, military, religious, and social competencies. Within this extensive sphere of authority, the ḳāḍī constituted a juridico-religious bridge between the state and society. This article investigates the administrative, social, and legitimacy-related dimensions of the institution of the ḳāḍī within the framework of the Great Seljuk State’s conception of justice. By drawing on the manshūrs and correspondence found in Muntajab al-Dīn Badīʿ’s inshāʾ collection, ʿAtabat al-kataba, as well as other primary Seljuk sources and modern historiography, this article examines the administrative, social, and legitimizing dimensions of the ḳāḍī’s office. Furthermore, it analyzes the specific duties of the ḳāḍī and his functional relationship with other administrative officials, such as the wālī, the shiḥna, the raʾīs.
