DİLENCİLİK SORUSU VE DİLENCİLİK YASAKLARINI İNSAN HAKLARIYLA ELE ALMAK: LACATUS v. İSVİÇRE KARARININ UYANDIRDIKLARI

Öz

Bu çalışma, dilenciliği engelleyerek yaptırıma bağlayan yasa ve uygulamaları insan hakları boyutu bakımından konu edinmektedir. Konuya ilişkin bölgesel tarihsel kayıtlar ışığında dilencilik yasaklarını geçmiş ve günümüz arasında bir değerlendirmeden geçirerek, günümüz dilencilik yasalarının rasyoneline ilişkin eleştirel sorular ve potansiyel insan hakları sorunları ortaya koymaktadır. Buna parelel olarak, günümüz dilencilik karşıtı yasalar karşısında insan haklarının nasıl bir rol oynayacağı sorusunu yakın zamanlı bir AİHM kararı üzerinden sorgulamaya açmakta, kararın konu edindiği ve eksik bıraktığı hukuki tartışmaları farklı hukuk sistemleri ışığında tartışma edinmektedir.

TACKLING THE QUESTION OF BEGGING AND BEGGING BANS THROUGH HUMAN RIGHTS: WHAT LACATUS v. SWITZERLAND EVOKE

Öz

This study tackles the laws and practices that prohibit and sanction begging through a human rights perspective. In light of the regional historical records on the subject, the study evaluates the past and current begging prohibitions by critically questioning the motives of the contemporary bans and puts forward some potential human rights questions. In parallel to this, it questions the role and use of human rights against the contemporary bans on begging through examining a recent ECtHR case and discusses the legal arguments that were addresses and neglected by this decision in light of the diverse legal systems.
