The trade name is the name used by the merchant while carrying out one’s business transactions. The trade name mainly functions as a commercial promotion and differentiate a merchant from the other merchants. The trade name has material and moral value for the business and the merchant. Due to the significance of the trade name, it is very important to protect it. As a matter of fact, third parties may want to take advantage of the trade name. In this case, it is important for the merchant to know by which legal means he will protect his trade name. Although trade name and trademark are different concepts, there are functional similarities between these two concepts. Due to this similarity, violations of rights and violations may occur between the two signs. For this reason, the current study briefly focuses on the concepts of trade name and trademark and the protection of the trade name is examined within the scope of the Turkish Commercial Code and Industrial Property Law.
