UZAY HUKUKUNUN GELİŞİMİ VE DEĞİŞİMİ

Abstract

Uluslararası Uzay Hukuku’nun ortaya çıkışının Soğuk Savaş döneminin ve bu dönemde yaşanan olayların, (en önemlisi ve uzay yarışı ve rekabeti hızlandıranı Sovyetler Birliği’nin 1957 yılında dünya çevresinde dönmek üzere ilk uydu olan Sputnik-1’i uzaya göndermesidir) bir ürünü olduğunu söylemek yanlış olmayacaktır. Gelişimi ve Amerika Birleşik Devletleri ile Sovyetler Birliği'nin orijinal kurucu ilkelerin müzakeresinde oynadıkları roller hakkında çok sayıda çalışma yapılmıştır. Uluslararası uzay hukuku ve aslında uluslararası hukukun büyük bir kısmı şu anda temel mimarisinin önemli ölçüde değiştiği bir noktadadır. Bu durumu uzay araştırmalarına özel aktörlerin de artan katılımı desteklemekte ve hızlandırmaktadır. Bu çalışma, mümkün olduğunca, bu üzerinde çokça çalışılmış ve belgelenmiş alanı ve geçmişi tekrar ele almaktan kaçınacaktır. Ancak, uluslararası sistemin başat güçleri tarafından Soğuk Savaş dönemi şartlarında, kıran kırana rekabetin yaşandığı bir jeopolitik ortamda ortaya konan normlar ve düzenleyici kurallar ve ilkeler hakkında bir bakış açısı sunmayı da amaçlamaktadır.

DEVELOPMENT AND EVOLUTION OF SPACE LAW

Abstract

It would be fair to announce that the emergence of International Space Law is a product of the Cold War and its events (most notably, and the accelerator of the space race and competition, the Soviet Union's launch of Sputnik 1, the first satellite to orbit the Earth, in 1957). Numerous studies have been conducted on its development and the roles played by the United States and the Soviet Union in negotiating the original founding principles. International space law, and indeed much of international law, is currently at a point where its fundamental architecture has undergone significant change. This is supported and accelerated by the increasing participation of private actors in space exploration. This study will, to the extent possible, avoid rehashing this well-studied and documented field and its history. However,but it also aims to offer a perspective on the norms, regulatory rules, and principles established by the dominant powers of the international system during the Cold War, amidst a fiercely competitive geopolitical environment.
