Uluslararası Hukuk Boyutuyla Hukukun Üstünlüğü

Abstract

Bütün demokratik toplumların ortak belirleyici özelliği olması itibarıyla hukukun üstünlüğü, özgür ve müreffeh bir toplumun en önemli önşartıdır. Günümüzde hukukun üstünlüğü, sosyal, ekonomik ve politik sonuçlarla doğrudan ilgili olduğu için, ulusal ve uluslararası boyutlarda bütün hukuksal ve siyasal tartışmaların odağında bulunmaktadır. Hukukun üstünlüğü kavramı, devletlerin ve hükümetlerin hukuksal ve siyasal karar ve hareketlerinin eleştirilmesi, takdir edilmesi, meşruluğu veya gayrimeşruluğunun tartışılmasında hukukçular, politikacılar, devlet adamları ve medya tarafından sıkça kullanılmasına rağmen, kavramın ne olduğu konusu hâlâ net olarak açıklanamamaktadır. Bu sebeple, bu makalede, devletin sınırları ötesinde bir değerlendirme yapmak suretiyle, daha öz ve açık bir hukukun üstünlüğü kavramı için daha geniş anlamda işlevsel bir tanımlama yapmaya ve kamu kudretini hukuk yoluyla düzenlemeye olan mutlak ihiyaç hakkında farkındalığa katkı sağlamak amaçlanmıştır.Şüphesiz, modern toplumların bu birincil ihtiyacı için devletin pozitif rol alarak, kuralları yerinde ve zamanında etkin ve doğru olarak uygulamasına, en az yöneten dinamik bir hukuk sistemini tesis etmiş olması kadar önem atfedilmektedir. Sadece devletin değil, aynı zamanda bireylerin ve toplumun bir bütün olarak yaklaşımı, tutum ve uygulaması hayati önemde görülmektedir

THE RULE OF LAW WITH THE INTERNATIONAL LAW DIMENSION

Abstract

The rule of law, as a determinant dimension of all democratic societies, is of paramount importance to a free and prosperous society. In recent years, the interest in social, economic and political consequences of the rule of law has become a prevalent concept in current legal and political discourse on both national and international levels. Although it is frequently used by legal scholars, politicians, statesmen and the news media to criticize or commend states and governments for the legitimacy or illegitimacy of legal and political actions and decisions, it is still however vague when it comes to explaining just what the rule of law is. For this reason, in this article, through a restatement of the rule of law that better explains its use beyond state borders, the attempt is to give a concise and clearer conception of the rule of law to provide a working definition for, in a broader sense, and promote awareness on the absolute need to channel the power through law. Without doubt, for this essential need of modern societies, through taking a positive role, the state should enact and implement the rules and laws in time and place effectively and properly. This is at least equally important for the state to have an effective and dynamic legal system established. Not only the state’s attitude of mind but also positive behaviour and attitudes of individuals and the society as a whole are deemed crucial importance
